Plat Book 133 at Page 39 of the Public Records of Miami-DadeCounty, Florida less Parcel III taken in
eminent domain filed in case #98-05139 and described as follows:
Those portions of Tracts "A" and "C", THE PROMENADE SHOPS, according to the Plat thereof, as recorded
in Plat Book 133, at Page 39, of the Public Records of Miami-Dade County, Florida, in the Southwest
one-quarter (S.W. ~) of Section 34, Township 51 South, Range 42 East, and being more particularly
described as follows:
Begin at the Southwest corner of said Tract "C"; thence along the West line of said Tract "C",

that the within survey (a) is an accurate survey of all the real property legally described herein, (b)

Gumberg Asset Management, the authorized representative of Prudential Insurance
Company of America, is proposing & submitting for approval a Mulit- Tenant Center
Sign Graphics Criteria for the Promenade Shops retail plaza on Biscayne Boulevard
In the City of Aventura, pursuant to Section 31-191 (i) of the City of Aventura Land
Development Regulations.
A.) General:
1.) All signage shall be designed, constructed and located in accordance with the
following design criteria and shall be subject to the written approval of the Landlord
and approved by the City of Aventura Planning and Zoning. The criteria has been
established to govern the design, fabrication and installation of the tenant signage
and is intended to provide all tenants with good visual identification.
B.) Procedural Requirements:
1.) Prior to sign fabrication, Tenant shall submit, or cause to be submitted, to Landlord
for approval, two (2) sets of detailed drawings indicating the location, size, layout,
fabrication and installation method, design, copy style and color of the proposed
signage, including window/door lettering and/or graphics. Drawings shall show the
full fascia with architectural features of the specific demised premise.
2.) Tenant's sign contractor shall be a reputable sign fabricator, whose principal
business is the fabrication of similar internally illuminated channel letter signs, who
has been in business for a minimum of three (3) years. Additionally, Tenant shall
submit, or cause to be submitted; to Landlord a Certificate of Compensation
Insurance of type coverage and limits as approved by Landlord in writing.
Certificate of Insurance shall name Landlord and its agents as additional insured.
No work on premise may commence without a Certificate of Insurance delivered to
the Landlord.

3.) Tenant shall be responsible for all required permits for their signage and the
installation thereof, including, but not limited to, those by the City of Aventura,
County of Dade, or State of Florida. In addition to those requirements listed herein,
tenant must adhere to any municipal code requirements that may further restrict
sign size, design or fabrication.
4.) Fabrication, installation and permit costs shall be at the Tenant's sole expense.
5.) Tenant shall be responsible for the maintenance and repair of its signage. If, after
fifteen (15) days notification to repair signage, no action has been taken by the
Tenant, the Landlord will contract to repair or maintain signage and the cost of
repair or maintenance will be invoiced plus twenty percent (20%) to the Tenant as
additional rent.
C.) Design Requirements:
1.) All signs are to be in the form of individually illuminated channel letters with plex
faces, mounted flush to building.
2.) Box signs, reverse channel letters, audible, flashing action or other mechanical
animation will not be permitted. Exposed wiring or raceways are prohibited. Interior
skeletal neon will be prohibited if it can be seen from the exterior of store. All
illuminated interior signage will require Landlord approval and tenant must obtain
permits as required by the building department.
3.) Unless otherwise approved by the Landlord or the City of Aventura Planning and
Zoning, in writing, sign text shall contain the company name only. Elaboration of
the company's products or services, slogans or other verbiage is not allowed.
D.) Tenant Sign Criteria
1.) It is the intent of the Landlord to encourage signage of a scale and proportion to the
Tenant's storefront width and fascia height. The maximum signage of a non-
anchor tenant will be determined by the following guidelines.
a.) Maximum square feet of tenant's sign will be one (1) square foot for each lineal
feet of leased store frontage. (Example: 20' frontage x 1 will permit 20 sqft
sign.)
b.) When leased space is located 300' or more from the property line, the tenant
will be allowed 1 % square feet for each lineal foot of leased store frontage.
(Example: 20' frontage x 1.5 will permit 30 sqft sign.)
c.) Length of sign will not exceed 80% of the length of the storefront. (Example: 20'
frontage x 80% will permit a sign not to exceed 16' in length.)
d.) Tenants may have single line or double line (stacked) copy, not to exceed
twenty-four (24) inch letters.
e.) If required by the City of Aventura, a Florida registered engineer must seal
drawings. Engineering costs will be the responsibility of the tenant.

2.) Each tenant will be allowed one (1) wall sign. The following exceptions will allow for
two (2) wall signs for a leased space.
a.) Tenants located on a corner of the shopping center, giving two (2) frontages
for that leased space.
b.) Tenants located in a leased space, which has an additional entrance for
public use on a separate elevation.
The allowed square footage for the second elevation will be 50% of the primary
sign on the first elevation.
3.) Tenant must have a permanent sign installed on building fascia no later than (45)
forty-five days after receipt of base building Certificate of Occupancy.
4.) The copy for wall signs will be limited to the name on the occupational license.
Logos may be permitted, but must be reviewed and approved by the Landlord and
the City of Aventura. Logos must be constructed with the same specifications as
the channel letters.
5.) Maximum height for the Anchor Tenant will be the sole discretion of the Landlord
and depending on the specific location of the Tenant as it relates to height and
width of sign area and to any municipal code requirements by the City of Aventura
Planning and Zoning, which may further restrict size. Only the major anchor
tenants will be included on the free-standing signs for Promenade Shops, if
provided by the landlord.
E.) Fabrication Specifications:
1.) Letter Material and Finishes:
a.) Letter material shall be a minimum of .040" aluminum returns and backs.
Faces shall be 3/16" plex with 1" trimcap. Depth of 24" channel letters will
be a minimum of 5".
b.) Color and copy style will be at sole discretion of the Landlord and must be
acceptable to the City of Aventura.
2.) Illumination:
a.) Letters shall be illuminated using neon tubing. No exposed neon will be
acceptable.
b.) Electrical components shall be UL approved, inspected and appropriately
tagged prior to installation.

F.) Installation:
1.) All installation components such as, but not limited to, fasteners, clips, bolts, etc.,
shall be of non-corrosive, stainless steel, aluminum, brass, bronze or carbon
bearing steel with painted finish. No black iron material of any type shall be
permitted.
2.) All penetrations of the fascia shall be neatly sealed in a watertight manner using a
single component polyurethane sealant as approved by Landlord. Tenant is
responsible for fascia penetrations and damage that may result, including but not
limited to, water damage.
3.) Location of all penetrations of the building fascia for conduit, sleeves, etc. shall be
shown on the approved detailed drawing submitted by Tenant.
4.) All fasteners for the sign installation shall be concealed. Method of installation to
the building fascia shall be approved by the Landlord in writing.
5.) Installation shall comply with all local codes and ordinances. Electrical work shall
be performed by a licensed electrician. Signage shall have an individually circuit
and controlled by a time clock and primary electric to the signage is the Tenant's
responsibility .
G.) Insurance Requirements:
All sign contractors installing signs at promenade Shops, shall be required to have a
current insurance policy in force with limits of no less than one million dollars
($1,000,000.00) for Commercial General Liability and Workers Compensation and
Employer's Liability in Compliance with applicable legal requirements of the State of
Florida.
H.) Door I Window Vinyls:
1.) Each tenant will be allowed (1) set of door/window vinyls. Layout & design must
be submitted to Landlord for approval. The vinyls must conform to the following
guidelines:
a.) Vinyls must be premium grade, opaque, white vinyls, applied first surface to the
main entrance door/window.
b.) Maximum allowable area may not exceed 4 square feet of copy area.

I.) Under Canopy Sign
The tenant shall identify leased space with (1) double face, non-illuminated
sandblasted wood or foam sign with company name. Color shall be the same
throughout the entire center. Tenant to submit (2) two drawings by a named sign
company for approval by the landlord.
J.) Out Parcel Signage
This center consists of several Out Parcel buildings. All wall signage must be
approved by the Landlord and the City of Aventura. Sign materials, design, size and
location will be approved by the Landlord and determined by the Aventura Sign Code.
