2000-04 ORDINANCE NO. 2000-04 AN ORDINANCE OF THE CITY OF AVENTURA, FLORIDA, AMENDING THE COMPREHENSIVE MASTER PLAN BY AMENDING THE FUTURE LAND USE MAP DESIGNATION FOR THE PROPERTY LOCATED AT 2890 NE 187 STREET FROM MEDIUM HIGH DENSITY RESIDENTIAL TO TOWN CENTER; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Department of Community Affairs of the State of Florida found in compliance the City of Aventura Comprehensive Plan (the "Plan") in February 1999; and WHEREAS, the Futura Land Use Map of the Plan designated the subject property Medium High Density Residential, consistent with the existing Miami-Dade County Comprehensive Plan; and WHEREAS, the City Commission adopted the City's Land Development Regulations (the "LDRs") in July 1999; and WHEREAS, in the process of developing the LDRs, it was determined that the zoning was inconsistent with the land use designation on the property;, and WHEREAS, the City Commission agreed to approve a town center zoning designation on the subject property, conditioned upon the acceptance of a Plan amendment; and WHEREAS, the Plan amendment will not result in impacts on any infrastructure system that will exceed established level of service standards and is otherwise consistent with the goals, objectives and policies of the Plan; and Ordinance No. 2000-04 Page 2 WHEREAS, the City Commission believes it is in the best interest of the public to amend the future land use map designation on the subject property from Medium High Density Residential to Town Center; and WHEREAS, the City Commission believes the amendment will maintain the unique aesthetic character of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF AVENTURA, FLORIDA, AS FOLLOWS: Section 1. Purpose. This Ordinance is intended to preserve the unique aesthetic character of the City and ensure that adjacent land uses are compatible. It is further intended to protect property values, create a better business climate, enhance the physical appearance of the community and preserve the natural beauty of the City. Section 2. Amendment of Future Land Use Map Desi,qnation. The future land use map designation of the property legally de§cribed as: Beginning 180.25 feet North and 70 feet East of the Northeast corner of the Northwest % of the Southeast ~ of the Southwest % of Section 3, Township 52 South, Range 42 East, Miami-Dade County, Florida, thence South along the East right-of-way line of NE 29 Avenue 49.74 feet to the Point of Beginning, thence in a Southwesterly arc a distance of 314.90 feet West along the South right-of-way of NE 187 Street 142.58 feet South 188.64 feet to the point of commencement of a curve thence southeasterly along an arc 23.60 feet to point of commencement of a reverse curve thence along an arc 37.50 feet thence East 297.03 feet thence North 216.10 feet East along the North bank of the canal 20 feet North 225.41 feet to the Point of Beginning a/k/a 2890 NE 187 Street is changed from Medium High Density Residential to Town Center. 2 Ordinance No. 2000-04 Page 3 Section 3. Severability. The provisions of this Ordinance ara declarad to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the ramaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section4. Transmittal. The City Clerk is directed to transmit the amendment to the State of Florida Department of Community Affairs. Section 5. Effective Date. This Ordinance shall be effective pursuant to Chapter 163 of the Florida Statutes. The foregoing Ordinance was offered by Commissioner Eo§ers-L~bert , who moved its adoption.
