CITY COMMISSION MEETING
TUESDAY, JULY 20, 1998 8:15 P.M

1. CALL TO ORDER/ROLL CALL: The meeting was called to order at 8:15 p.m. by
Mayor Arthur I. Snyder. Present were Commissioners Arthur Berger, Jay R. Beskin,
Harry Holzberg, Jeffrey M. Perlow, Patricia Rogers-Libert, Vice Mayor Ken Cohen,
Mayor Snyder, City Manager Eric M. Soroka, City Clerk Teresa M. Smith, and City
Attorney Stephen Jay Helfman. As a quorum was determined to be present, the
meeting commenced.
A motion was offered by Commissioner Perlow, seconded by Commissioner Holzberg
and unanimously passed by roll call vote to add to the agenda as item 3 - Motion to
authorize City Attorney to prepare and present to the City Commission a proposed
ordinance providing for a moratorium relative to building height.
2. PUBLIC HEARING: ORDINANCE- FIRST READING:
AN ORDINANCE OF THE CITY OF AVENTURA, FLORIDA, ADOPTING
THE COMPREHENSIVE PLAN OF THE CITY OF AVENTURA (THE
"PLAN"), PURSUANT TO SECTION 163.3161, ET SEQ. FLORIDA
STATUTES, "LOCAL GOVERNMENT COMPREHENSIVE PLANNING
AND LAND DEVELOPMENT REGULATION ACT;" PROVIDING FOR
SEVERABILITY; REPLACING PREVIOUSLY APPLICABLE MIAMI-DADE
COUNTY COMPREHENSIVE PLAN; PROVIDING FOR AN EFFECTIVE
DATE.
Mayor Snyder opened the public hearing. There being no speakers, the public
hearing was closed. A motion for approval was offered by Commissioner Beskin,
seconded by Commissioner Rogers-Libert and unanimously passed by roll call vote.
3. Mr. Helfman explained the discussion of the Commission at the previous
Workshop relative to providing a moratorium on the issuance of development
orders or permits relative to height limitation.
A motion was offered by Vice Mayor Cohen and seconded by Commissioner
Berger to authorize the City Attorney to prepare and present to the City
Commission a proposed ordinance providing for a moratorium upon the issuance
of development orders or permits for: (1) any proposed multi-family residential
building exceeding a height of 40 stories; and (2) any proposed multi-family
residential building in excess of its previously approved height, even if such
previously approved height was less than 40 stories. The proposed moratorium
would be for the duration of the preparation of the Land Development
Regulations.
An amendment was offered by Commissioner Beskin, seconded by
Commissioner Rogers-Libert and unanimously passed to delete "multi-family"
from sections (1) and (2).
City Attorney instructed to prepare proposed ordinance including concerns of the
Commission as expressed.
The motion, as amended, passed unanimously by roll call vote.
4. ADJOURNMENT: There being no further business to come before the Commission
at this time, after motion made, seconded and unanimously passed, the meeting
adjourned at 8:40 p.m.
