Recommendation
It is recommended that the City Commission approve the attached ordinance amending the
2005/2006 budget.
Backaround
As you are aware, we are in the process of closing the books for the 2005/2006 fiscal year. We
are now to the point where we can formally amend the budget so that the adopted budget
contains appropriations sufficient to cover all actual expenditures. The process is called the end
of year "clean up" amendment and is done as a matter of course each year.
Prior to last year, we processed the end of year amendment for inclusion on the February and
March agendas. However, Section 166.241 was revised by the 2004 legislature to require that
all budget amendments be made "within up to 60 days following the end of the fiscal year."
While this requirement is logistically impossible to comply with, we are attempting to comply by
having the first reading of the Ordinance before the November 29, 2006 deadline.
The only funds requiring amendment are the General Fund 2000 Loan Debt Service Fund and
Police Extra Detail Fund. Only those departments where their total department budget was
overspent are included on the amendment. In like manner, we only amend revenues by a total
amount equal to the total required amendment to expenditures. The general reason that
necessitated the amendment will be discussed for each department.
The Legal Department budget requires an increase of $60,000 due primarily to the oversight of
Gulfstream DRI matters and PBA Collective Bargaining Agreement issues.
Public Safety (Police) Department requires a revision of a total of $550,000. Of this amount
$110,000 is due to the unexpected continued increase in gasoline costs. A total of $440,000 is
required to pay for overtime and fringe benefits primarily due to Hurricanes Wilma and Ernesto.
A portion of the overtime costs were recovered from FEMA.

End of Year Budget Amending Ordinance
For Community Development, an increase of $760,000 was required to pay for building
inspection services by CSA Southwest due to the extremely high level of building activity during
the year. Additional revenues of $1.1 million offsets this increase in expenses.
The Community Services Department requires a total of $550,000 in additional appropriations.
A total of $220,000 is required for additional costs for the Summer Recreation Program and
Cultural Recreation Programs. This $220,000 is exactly offset by additional revenues. An
additional $100,000 is needed for engineering services primarily due to a high level of traffic
studies. Pre and post hurricane expenses for Hurricanes Wilma and Ernesto included $70,000
for clearing and drainage, $50,000 for building maintenance and $20,000 in overtime. A portion
of this amount was recovered from FEMA and the State of Florida. The expense for water was
$90,000 higher than budget primarily due to drier than normal conditions for a part of the year.
Non-Departmental requires an additional $1,680,000 primarily due to hurricane related
expenses for contractor's services relating to Hurricanes Wilma and Ernesto. A portion of these
costs will be recovered from FEMA. An additional $2,000 requires transfer to the 2000 Loan
Debt Service Fund as discussed below.
The 2000 Loan Debt Service Fund requires an appropriation increase of $2,000 because it was
underestimated when budget was prepared.
The Police Off Duty Services Fund requires an increase of $9,000 because calls for off duty
services were slightly greater than projected. Since this fund is paid for by the companies
requesting off duty services, revenues exactly offset the $9,000 in costs.
As discussed earlier, the vast majority of the increase in costs are wholly or substantially offset
by increased revenues. For those expenses not directly offset by revenues, I identified one of
the unrestricted revenues that was greater than budgeted.
Since the majority of the increase in expenses are offset by increases in revenue, this
amendment will have no significant impact on the 2006/07 or future years' budgets. The
amount of the projected carryover which is included in the 2006/07 budget will be substantially
the same as the actual carryover, once all transactions are recorded and financial statements
prepared.
Based on the foregoing, I recommend approval of the Ordinance.

WHEREAS, upon the periodic review and analysis of current budgetary
commitments and obligations, and based upon the projected needs and requirements
of the City and upon the recommendations of the City Manager (and the concurrence of
the Finance Support Services Director as to Accounting Principles), it is deemed
necessary to adjust, amend and implement the 2005/2006 Operating and Capital
Budget as set forth in Exhibit "A" attached hereto and made a part hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF AVENTURA, FLORIDA, AS FOLLOWS:
Section 1. The recitals contained in the preamble to this Ordinance are
incorporated by reference herein.
Section 2. The City Commission hereby authorizes the amendment of
Ordinance No. 2005-13, which Ordinance adopted a budget for the 2005/2006 fiscal
year, by revising the 2005/2006 budget as set forth on the attached Exhibit "A" which
exhibits are deemed incorporated by reference as though set forth in full herein.
Section 3. The City Manager is hereby authorized to do all things necessary to
carry out the aims of this Ordinance.

upon adoption on second reading.

RECOMMENDATION
It is recommended that the City Commission adopt the attached Ordinance which
increases the amount required for competitive bids.
BACKGROUND
Currently, the City's Code of Ordinances provides that expenditures of $15,000 or more
require formal competitive bidding and award by the City Commission. This Ordinance
was adopted in 1996.
As you are aware, the formal competitive bid requirements can result in a lengthy and
expensive process. In some cases, this process lends to the public's perception that
government moves too slow. I would like to cite a few examples:
1. The cost of installing fencing around the Charter School's campus is $45,000.
The competitive bid process will delay the installation by two months and
increase the cost due to advertising and the preparation of formal bid
documents.
2. The cost of replacing the paver bricks on Turnberry Way that were displaced
by the County's Public Works Department in order to repair a water main is
$25,000. The competitive bid process has delayed the completion of this
work by several months and increased the cost.
Based on the foregoing, I feel it is time to reexamine the purchasing level required for
competitive bids. It is recommended that the City Commission adopt an Ordinance

increasing the level from $15,000 to $50,000 to expedite the important projects on
behalf of our residents.
Purchases under $50,000 but over $2,500 would still require three quotations from
individual vendors.

guidelines and procedures, as set forth herein, is in the best interest of the City.
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE CITY
COMMISSION OF THE CITY OF A VENTURA, FLORIDA, AS FOLLOWS:
Section 1. Recitals Adopted. That each of the above stated recitals are hereby
adopted and confirmed.
Section 2. City Code Amended. That Chapter 2 "Administrati on" of the City Code
is hereby amended by revising Division 3., at Section 2-252 "Purchas ing Guidelines", Section
2-253 "Exemption s from Competitive Formal Bidding", Section 2-256 "Award of
Professional Services Contracts", to read as follows: 1
DIVISION 3. PURCHASING
Sec. 2-252. Purchasing Guidelines.
(a) Purchases not greater than $2,500.00. Purchases of or contracts for materials,
supplies, equipment, improvements or services where the total amount expended is
not greater than $2,500.00 may be made or entered into by the City Manager
without competitive bidding and without City Commission approval.
(b) Purchases of more than $2,500.00 but less than $15,OOOJ)() $50,000.00. Purchases
of or contracts for materials, supplies, equipment, improvements or services where
the total amount expended is in excess of $2,500,00, but which is less than
$15,000.00 $50,000.00, may be made or entered into by the City Manager without
City Commission approval, provided that three quotations are obtained from
individual vendors.
(c) Purchases of $15,000.00 $50,000.00 or more. Except as exempted by sections 2-
253 and 2-256, purchases of or contracts for materials, supplies, equipment,
improvements or services where the total amount expended is $15,000.00
$50,000.00 or more shall be awarded by the City Commission after formal
competitive bidding.
Sec. 2-253. Exemptions from Competitive Formal Bidding.
The following exemptions from competitive formal bidding are hereby established:
(1) Sole source availability. Supplies, equipment or services available from a
sole source only may be exempted from the bidding requirements of this division
by the City Manager upon the filing of a written request by a department head to
the City Manager outlining the conditions and circumstances involved,
(2) Purchases made under state contracts or vrocedures. Purchases made under
state purchasing contracts or procedures pursuant to:
a, F.S. S 287.042; or
b. State General Service Administration Contracts, or Federal, County or
other governmental contracts; or
c, Cooperative bids with other governmental agencies; or
1/ Proposed additions to existing City Code text are indicated by underline; proposed deletions from

d. Continuing contracts as defined in and authorized by Section 287,055,
Florida Statutes;
shall be exempt from the competitive bid requirements of this division.
(3) Professional services. Contracts of less than $15,000.00 $50,000.00 for the
professional services of attorneys, physicians, professional consultants, planners,
court stenographers, real estate brokers and other professions licensed and
regulated by the State, and (if not exempted pursuant to Sec. 2-253 (2)(d) above)
contracts for those professional services governed by F.S. 9 287.055, the
Consultants Competitive Negotiation Act (the "CCNA") which do not exceed the
Category Two CCNA threshold amount which is described in Sec, 287.017 (1)
(b), Florida Statutes, may be entered into by the City Manager without formal
competitive bidding under this division, unless otherwise required by applicable
law.
(4) Purchases below minimum amount, Purchases of less than ~,GOO.OO
$50,000.00 shall be exempt from the competitive bid requirements, unless
otherwise mandated by applicable law.
(5) Emergencies. Purchases arising out of or because of emergencies shall be
exempt from the competitive bid requirements. Emergencies constitute a
situation, occurrence or matter necessitating immediate or quick action and not
permitting adequate time to utilize competitive bidding,
(6) Impracticability. Under circumstances where competitive bidding is
impracticable, including but not limited to situations where time constraints do
not permit the preparation of clearly drawn specifications or situations where,
after competitive bidding, no bids meeting bid requirements are received, all
compliant bids received are too high, or all bids are rejected for failure to meet bid
requirements (i.e., bids are noncompliant), such purchases shall be exempt from
the competitive bid requirements.
Sec. 2-256. A ward of Professional Services Contracts.
The requests for proposal/requests for qualifications process shall be utilized for the
awarding of contracts of $15,000.00 $50,000.00 or more for the professional services of
attorneys, physicians, professional consultants, planners, court stenographers, real estate brokers
and other professions licensed and regulated by the State, and for professional services governed
by F.S. ~ 287.055, the Consultants Competitive Negotiation Act (the "CCNA") unless exempt
under Sec. 2-253(2)(d) above as a continuing contract under the CCNA. All such awards shall
be made by a resolution adopted by the majority of the City Commission, The City Commission
may, by motion, waive the requirement to utilize requests for proposaVrequests for qualifications
if it is determined to be in the best interests of the City to do so or as otherwise authorized by
law.

Section 3. Inclusion in the Code. That it is the intention of the City Commission,
and it is hereby ordained that the provisions of this Ordinance shall become and be made a part
of the Code of the City of A ventura; that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "0 rdinance" shall be changed to
"Section" or other appropriate word,
Section 4.
Severability. That the provisions of this Ordinance are declared to be
severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason
be held to be invalid or unconstitutional, such decision shall not affect the validity of the
remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in
effect, it being the legislative intent that this Ordinance shall stand notwithstanding the
invalidity of any part.
Section 5. Effective Date. That this Ordinance shall be effective immediately upon
adoption on second reading.
