SUBJECT: Gulfstream Property
Attached hereto for your further use and review are the reports of two field inspections
of the aforementioned property. Mindy Parrot, a biologist for our consulting engineers,
Keith and Schnars, performed the first inspection on May 10, 2000. Edward A. Swakon
of EAS Engineering, Inc. performed the second inspection on May 15, 2000. Mr.
Swakon is an environmental engineer whose firm specializes in wetland permitting and
environmental consulting.
SUMMARY
Both reports conclude that approximately 1.6 acres of the site (27%) consists of
mangrove-forested wetlands that are tidally connected via the drainage ditch to the
Introcoastal Waterway. Permitting would be required from Miami-Dade County, the
State of Florida and the federal government. .'~ twenty-five foot upland buffer would be
needed along the edge of the existing wetlands. The permitting process would take
approximately one year to complete, and significant evidence would need to exist to
demonstrate that there were no upland alternatives available at the time the property
was purchased. This process and analysis can be quite rigorous at the federal level.
Unavoidable impacts upon the existing wetlands must be mitigated, and the mitigation
ratios could cost from $500,000 to $1,400,000.
A comprehensive Phase I and II environmental audit is needed due to the suspect
material that has been dumped onsite. This material consists of 55-gallon drums,
mounded soil, abandoned vehicles and other assorted solid waste. All of these items
are potential sources of contamination.

Dear Mr. Sherman:
Keith and Schnars, P.A. (K&S) is pleased to provide a summary of the information
obtained during our field visit to the Site. The purpose of this field visit was to identify
the Site's existing conditions in terms of natural resources, sources and possible
environmental concerns.
The subject property, hereafter referred to as the "Site", is an approximate 6-acre parcel
located adjacent to Gulfstream Park on Northeast 2131h Street. Per your verbal
authorization on May 10, 2000, a K&S envin ',lillental scientist visited the Site on that
date. The results for each area are described benw.
Wetlands
During the site visit two wetland areas were identified: a roadside ditch and a mangrove
forest. Please see the attached figure. The roadside ditch (tins panilld tu NE 213th Street.
It is vegetated with white mangrove (Laguncularia racemosa) seedlings, (Pluchea
rosea), and ruderal species. Water within the ditch, presumably saline (due to the
presence of mangroves), appeared yellowish in very shallow areas. Construction debris
was also common within the ditch. Fiddler crabs (family Ocipodidae) and land crab
(Ucides cordatus) holes were visible in this area.
The mangrove forest area (approximately 1.6 acres) consists largely of white mangrove,
but a few black mangrove (Avicennia germinans), buttonwood (Conocarpus erectus) and
royal palms (Roystonea elata) were also observed. The larger trees reach as high as 30
feet. The shrub and ground cover layers also.onsisted of juvenile white mangrove. A
few specimens of mangrove fern (Acrostichum aureum) were observed. This species is

listed by the Florida Department of Agriculture as Endangered. The soil in this area was
mucky and was very moist and may be inundated during high tides. The adjacent ditch
appears to provide a hydrologic connection to nearby tidal waters. Evidence of wildlife
use includes raccoon tracks, fiddler crabs (family Ocipodidae) and mangrove land crab
(Ucides cordatus) holes. In general, this area appears to be a healthy, mature mangrove
stand. Development of this site would require extensive mitigation for removal of this
resource.
Site Conditions
Surrounding the mangrove area are filled areas in various states of disturbance. At the
eastern end, the filled area is vegetated with Australian pine, Brazilian pepper, castor
bean, and sod. To the north and east, the vegetation includes castor bean, torpedo grass,
silk reed, and Brazilian pepper. These areas are filled irregularly, with several large fill
piles present. Within these piles, and on the ground, waste materials and construction
debris were observed. North of the mangrove area, there are two large construction -size
dumpsters overflowing with household and construction debris. Also present are two
piles of mulch material and one pile of sand.
The Site also contained several nursery areas containing ornamental plants, presumably
for use at Gulfstream Park. The northern boundary is vegetated with weeping fig (Ficus
benjamina) and Australian pine.
Conclusion
Approximately 1.6 acres of the Site consists of mangrove- forested wetlands. This
wetland area appears to be a healthy functioning ecological community, with large,
mature mangrove trees. The remainder of the Site is filled with suspect material and is
littered with solid waste. It was not pos;i'Jle to determine the suitability of the material
for construction purposes during the brief site inspection. Soils within the mangrove area
consist of muck, which may be several feet deep.

Please accept this letter as a summary of our field inspection and discussion regarding the above
referenced property_ We have reviewed the letter report of the existing conditions prepared by Keith
& Schnars, dated May IS. 2000, and agree with their findings. The mangroves arc tidally connected
via the roadside di tch_
Our conclusions and opinions about the site are as follows:
I) If any wetlands are to be impacted, permits wo~ld be required from Miami-Dade COWlty
DERM. the State of Florida (FDEP or SFWM )) and the federal government (U.S. Army
Corps of Engineers).
2) A site plan with no proposed direct impacts to wetlands would still need a 25-foot upland
buffer along the edge of the existing wetlands_
3) The permitting process may take approximately twelve months.
4) As part of the permitting process, an applicant must demonstrate that there were no upland
altemati ves available at the time the property was purchased. The site selection process must
be well docwnented_ This is important when you are purchasing property for a specific
purpose and do nOl already own property. The available upland alternatives analysis can be
quite rigorous at the federal level and should not be laken lightly.

5) Assuming that no alternative upland sites are available, the utilization of the site will be
reviewed for avoidance, minimization, and mitigation for wetland impacts. This means that
if wetland impacts are proposed, the applicant must clearly demonstrate why the wetlands
on the site must be impacted in order for the project to succeed. Unavoidable impacts must
be mitigated.
6) Mitigation will be substantial. In general, agencies prefer on-site mitigation (i.e. create new
mangrove or wetland areas within the project boundaries). Most likely, this option would not
be available here. Off-site mitigation then must be considered. Both on-site and off-site
options usually require success criteria, monitoring and maintenance. As a guide, the County
accepts contributions into a county trust fund, the Biscayne Bay Environmental Enhancemeti
Trust Fund (BBEETF). Asswning all 1.6 acres of mangroves were to be mitigated at
mitigation ratios between 2: I to 5: 1 (mitigation impacts), mitigation contributions to the
BBEETF would range between $558,000 and $1,400,000.
7) The material dumped on the site suggests the need for a comprehensive Phase I and II
Environmental Audit. A Phase I Audit consists of a site inspection and historical review of
the property; a Phase II Audit consists of soil and groundwater sampling. Observations
during the inspection include: 55 gallon drums, mounded soil, abandoned vehicles, etc.,
which are all potential sources of site contamination.

Dear Eric,
The boundaries for the Annexation study of taxation/services
would be:
North: County Line Road
South: Miami Gardens Drive(it could go past this
to the Oleta River(Ojus/west Dixie Highway area).
East: Biscayne Blvd.
West: 1-95 at 18 Av. with an alternative of property
west of 18 Av. that is on the north side of 191 St.(Rolling
Green Apts. and Presidential Estates and Coventry homes).
A further alternative would be Miami Gardens Drive north
which would pick up the Skyla~e Apts., Jade Winds and
other complexes north of North Miami Beach.
My guess is that we have 5-7000 people living in the 1st
scenerio and another 2-4,000 thousand by adding the 3d
scenerio.
Presidential and Coventry are Homeowner ares with values of
$400,000 to $1,000,000. Rolling Green values would be in the
$30,000-$50,000 range(a guess) ann other complexes would
be less.
