Resolution Awarding Bid for Electrical Security System

Recommendation
It is recommended that the City Commission adopt the attached resolution which awards
the bid for the electrical security system for the Aventura Government Center. The
resolution accepts the bid of Advanced Technology Systems Integrators, the lowest bidder
for the project.
Background
The award of the bid will allow the security system to be completed at the same time as
the balance of the work on the Government Center.
The City published an Advertisement for bids for this system in the Miami Herald on
February 7, 2000. Pre-bid meetings were attended by representatives from eleven (11)
firms, nine of which purchased the plans and specs. Sealed bids were received from four
firms and were publicly opened on February 28,2000. (Attachment 1)
From the time of the bid opening, there has been a series of informal accusations and
counteraccusations relating to Advanced Technology Systems Integrators (Advanced), the
lowest bidder. Based on these accusations and the fact that Advanced's bid was
significantly lower than the other three bids, we performed an even more stringent
investigation than normal.
We were able to satisfactorily resolve any questions about Advanced's bid packet and
accusations concerning performance on past security system installations. We performed
telephone investigations of all references listed by Advanced, plus other jobs performed by
Advanced which were brought to our attention by others. Favorable recommendations for
past work was received from every company that we contacted.

We discussed their bid amount with Advanced and have been assured that they
properly bid the job and that they will request no change-orders unless we change the
quantity of items from what was included in the plans and specs.
Based upon our research on this matter, we request that the City Commission award
the bid to Advanced Security Systems Integrators, the lowest responsive and
responsible bidder. The first year cost of this bid award will be $152,777 with second
and third year maintenance totaling an additional $18,600.

WHEREAS, the City Manager of the City of Aventura, Florida, has, pursuant
to the various laws of the State of Florida and the Code of the City of Aventura,
properly solicited and accordingly accepted bids for BID NO. 00-02-28-3,
ELECTRICAL SECURITY SYSTEM FOR AVENTURA GOVERNMENT CENTER;
and
WHEREAS. sealed bids have been submitted to and received by the City
pursuant to the City's Invitation to Bid/Notice to Bidders, specifications, proposals,
and requirements for the project/work as cited above; and
WHEREAS, staff has determined that Advanced Technology Systems
Integrators has submitted the lowest responsible and responsive bid for said
projectlwork; and
WHEREAS. the City Commission, upon the recommendation of the City
Manger, is therefore desirous of awarding said bid/contract to said lowest
responsible and responsive bidder;
NOW. THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF AVENTURA, FLORIDA, THAT:
Section 1: The bid/contract for BID NO. 00-02-28-3 ELECTRICAL
SECURITY SYSTEM FOR AVENTURA GOVERNMENT CENTER, is hereby
awarded to Advanced Technology Systems I ntergrators , Inc., in the base bid
amount of $152,777.41.
Section 2: The City Manager is hereby authorized to execute, on behalf of
the City, a contract by and between the parties embodying the terms, conditions,

specifications as set forth in the subject invitation to Bid/Notice to Bidders, bid
specifications, bid proposal and bid requirements, or if a City prepared contract was
part of said bid proposal, said parties shall execute said prepared contract on behalf
of the City.
Section 3: The City Manager is hereby authorized and requested to take all
necessary and expedient action to carry out the aims of this Resolution in awarding
this bid/contract.
Section 4: That the funds to be allocated and appropriated pursuant hereto
and for the purpose of carrying out the tenets of this Resolution shall be from the
General Fund Line Item No. 320-9001-590-6201.
Section 5: This Resolution shall be effective immediately upon its
adoption.

RECOMMENDATION
It is recommended that the City Commission adopt the attached Resolution authorizing
the City Manager to execute the contract for Bid No. 00-04-18-3, Country Club Drive
Safety Improvements to the lowest responsible and responsive bidder, DAVCO
Electrical Contractors Corporation for the re-negotiated price of $664,000.00. The
original bid amount was $756,889.13.
BACKGROUND
The City Commission awarded the bid at the May 2, 2000 Meeting subject to
negotiation of the bid amount. Based on revisions to the contract fostered by value
engineering (see attached letter), the bid amount was reduced without compromising
the project. The requested revisions have been reviewed with the inspectors and
engineers and they concur with the items.

1. The undersigned BIDDER proposes and agrees, if this Bid is accepted, to enter into an
agreement with The City of Aventura in the form included in the Contract Documents to
perform and furnish all Work as specified or indicated in the Contract Documents for the
Contract Price and within the Contract Time indicated in this Bid and in accordance with

the Contract Price, within the Contract Time and in accordance with the other

be required by BIDDER for such purposes.
(e) BIDDER has reviewed and checked all information and data shown or indicated
on the Contract Documents with respect to existing Underground Facilities at or
contiguous to the site and assumes responsibility for the accurate location of said
Underground Facilities. No additional examinations, investigations, explorations,
tests, reports or similar information or data in respect of said Underground
Facilities are or will be required by BIDDER in order to perform and furnish the
Work at the Contract Price, within the Contract Time and in accordance with the
other terms and conditions of the Contract Documents.
(f) BIDDER has correlated the results of all such observations, examinations,
investigations, explorations, tests, reports and studies with the terms and
conditions of the Contract Documents.
(g) BIDDER has given Consultant written notice of all conflicts, errors, discrepancies
that it has discovered in the Contract Documents and the written resolution
thereof by Consultant is acceptable to BIDDER.
(h) This Bid is genuine and not made in the interest of or on behalf of any
undisclosed person, firm or corporation and is not submitted in conformity with
any agreement or rules of any group, association, organization, or corporation;
BIDDER has not directly or indirectly induced or solicited any other BIDDER to
submit a false or sham Bid; BIDDER has not solicited or induced any person, firm
or corporation to refrain from bidding; and BIDDER has not sought by collusion
to obtain for itself any advantage over any other BIDDER or over the City.
BIDDER understands and agrees that the Contract Price is lump sum to furnish and
install all of the Work complete in place. The Schedule of Values is provided for the
purpose of Bid Evaluation and when initiated by the City, the pricing of change
orders. Contractor's price will not be adjusted to reflect any deviation from the
Schedule Of Values, except to the extent that the City changes the scope of Project

IDENTICAL TIE BIDS
Whenever two or more Bids which are equal with respect to price, quality, and service are received
by the State or by any political subdivision for the procurement of commodities or contractual
services, a Bid received from a business that certifies that it has implemented a drug-free workplace
program shall be given preference in the award process. Established procedures for processing tie
Bids will be followed if none of the tied vendors have a drug-free workplace program. In order to
have a drug-free workplace program, a business shall:
I) Publish a statement notifying employees that the unlav.ful manufacture, distribution,
dispensing, possession, or use of a controlled substance is prohibited in the workplace
and specifying the actions that will be taken against employees for violations of such
prohibition.
2) Inform employees about the dangers of drug abuse in the workplace, the business' policy
of maintaining a drug-free workplace, any available drug counseling, rehabilitation, and
employee assistance programs, and the penalties that may be imposed upon employees for
drug abuse violations.
3) Give each employee engaged in providing the commodities or contractual services that
are under Bid a copy of the statement specified in subsection (1).
4) In the statement specified in subsection (I), notify the employees that, as a condition of
working on the commodities or contractual services that are under Bid, the employee will
abide by the terms of the statement and will notify the employer of any conviction of, or
plea of guilty or nolo contendere to, any violation of chapter 893 or of any controlled
substance law of the United States or any state, for a violation occurring in the workplace
no later than five (5) days after such conviction.
5) Impose a sanction on, or require the satisfactory participation in a drug abuse assistance
or rehabilitation program, if such is available in the employee's community, by any
employee who is so convicted.

I just learned from the City Clerk that the decision was made to recommend awarding the
electrical security system project for the A ventura Govenunent Center ro Advanced
Technology Systems. TEM Systems is very disappointed with this decision,
Our response ro your request for bid was carefully drafted to include all details as
specified in the bid documents. TEM also presented the City with an open Architecture
solution for access control that would not make the City hostage to out dated hardware in
the future. TEM is also a total solution provider. A TS will have to subcontract the gated
portion of this business. TEM has been in the gated business for over 30 yean, The fact
that ATS's response was substantially lower ($99,775.47) than the other three companies
that bid can only lead one to assume that there was an error made on their part, they will
employ a lesser quality equipment, or that items were not included. We suspect that may
be the ease and that their only recourse (after award) will be to pr<::sent you with a series
of change orders to make up the difference. TEM Systems does not believe in doing
business in this manner.
rEM Systems intends ro monitor ATS's involvement and the progress of this project
closely. We may choose to readdress this award in the future should it become evident
that A TS is doing the change order "bump".
