RECOMMENDATION
It is recommended that the City Commission adopt the attached Resolution which ranks
the construction firms to perform Construction Management Services (CMS) with a
Guaranteed Maximum Price (GMP) relative to the Government Center, Police Facility &
Cultural Center project. The Resolution ranks the firm of James A. Cummings, Inc. as
the recommended company of the Review Team and authorizes the City Manager to
negotiate a contract and GMP.
BACKGROUND
As previously authorized, the City issued an Invitation to Submit Qualifications (ISQ) for
qualified firms to provide Construction Management Services with a Guaranteed
Maximum Price relative to the Government Center, Police Facility & Cultural Center
project. This process was selected to expedite the project and guarantee the cost of the
project. A Review Team consisting of the Finance Support Services Director, Assistant
to the City Manager, Representatives from Michael A. Shiff & Associates and
Arquitectonica (the project architects) and the City Manager was formed to receive and
evaluate the proposals and interview firms to prepare a recommendation to the City
Commission.
The following is a brief summary of the action taken by the Team to arrive at our final
recommendation:
1. An ISQ advertisement requesting Construction Management Services
with a Guaranteed Maximum Price was placed in the newspaper and
distributed to the vendor list.
2. On July 24, 1998, proposals were publicly opened from the following
firms:
Lanzo Construction Company
Danville Findorff
James A. Cummings, Inc.
CRSS Constructors, Inc.
3. A shortlist of the following firms was developed and representatives for
the firms were interviewed by the Team on August 18, 1998:

CRSS Constructors, Inc.
4. Based on extensive presentations, interviews and the criteria outlined in
the ISQ, each Team member ranked the firms independently and then
reached a decision to recommend one firm to the City Commission with
one alternate that would be called upon, should we fail to reach favorable
terms with the top ranked firm. A contract to establish the construction
management, overhead and profit fee will be negotiated with the
recommended firm.
Based on the process, which was very competitive, the Team recommends the firm of
James A. Cummings, Inc. be ranked number one and the City Manager be authorized
to commence negotiations. The Team recommends that the firm of CRSS Construction
be ranked second and be called upon in the event we cannot come to favorable terms
with the number one ranked firm.
Although the top two firms were well qualified for the project and the rankings were very
close, the edge was given to James A. Cummings, Inc. based on their experience with
similar projects and proven construction management expertise.
Now that the Team has completed its work, the following actions are necessary to
complete the process:
1. Adopt the attached Resolution, which serves three (3) specific purposes.
First, it ranks the firms. Second, it authorizes the City Manager to
negotiate the contract and GMP. Third, it establishes another firm as an
alternate, should we be unable to reach favorable terms with the selected
firm.
2. After the contract is negotiated, it will be presented to the City
Commission at the next meeting.

WHEREAS, the City of Aventura, in accordance with applicable State law, has
requested proposals from firms for services relative to Construction Management with

WHEREAS, said proposals were evaluated by a Review Team consisting of the
City Manager, Assistant to the City Manager, Director of Finance Support Services, and
Representatives from Michael A. Shiff & Associates and Arquitectonica ; and
WHEREAS, said Review Team recommends the selection of the firm of James
A. Cummings, Inc., based on said firm's experience and qualifications; and
WHEREAS, said Review Committee recommends the selection of the firm of
CRSS Constructors, Inc. should the City be unable to reach favorable terms with the
number one ranked firm; and
WHEREAS, the City Commission desires to authorize the City Manager to
negotiate scope of services and fees with the recommended firm, and with the alternate
firm, should negotiations with the recommended firm be unsuccessful.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF AVENTURA, FLORIDA, THAT:
Section 1. The firm of James A. Cummings, Inc. be and the same is hereby
selected to perform Construction Management Services with Guaranteed Maximum
Price relative to ISO No. 98-7-24-2, Government Center, Police Facility, and Cultural
Center Design Project.
Section 2. The firm has been selected on the basis of its experience and
qualifications and has not finalized a fee structure or contract with the City. Therefore,

the City Manager shall immediately negotiate the services and basis of fees with said
firm.
Section 3. In the event the City is unable to come to favorable terms and fees
with the firm of James A. Cummings, Inc., the City Manager is hereby authorized to
negotiate scope of services and fees with the alternate firm of CRSS Constructors, Inc.
Section 4. This Resolution shall become effective immediately upon its
adoption.
The foregoing Resolution was offered by Commissioner

G. The City is not liable for any costs incurred by the submitter prior to the issua',ce
of an executed contract.
H. Firms responding to this ISQ must be available for presentations/interviews to the
Selection Committee, this may be in person or by phone as determined by the
Committee.
I. The contents of the proposal of the successful firm will become part of the
contractual obligations.
J. Proposals should respond to each item noted in III and IV in the order noted.
K. Proposals must be typed or printed. All corrections made by the submitter prior
to the opening must be initialed and dated by the submitter. No changes or
corrections will be allowed after proposals are opened.
II. PROJECT DESCRIPTION
INTENT
The City of Aventura, Florida is inviting the submission of qualifications from qualified
firms to provide construction management services for the construction of a new
government center, police station and cultural center building(s) and all related site
development.
BACKGROUND
The newly incorporated City of Aventura is planning to construct a new government
center, police station and cultural center. The City desires to contract for construction
management services as soon as possible. Construction will commence on or about
September 1, 1998.
The City of Aventura is approximately 3.2 square miles with an estimated population of
20,000. The City's new facilities include the following:
. 70,000 square feet
. Police Station on ground level
. Plaza level and cultural center/commission chambers on second level
. Police administrative and government center administrative offices on third level
. Government Center administrative and elected officials' offices on fourth and fifth
levels
. Provides approximately 175 parking spaces

The firms of Michael Shiff & Associates, as prime consultant, and Arquitectonica
provided architectural services for the design and preparation of design criteria package
for the project.
III. REQUIRED SUBMITTALS
Please submit the following information, with responses numbered accordingly, on
8.5" x 11" sheets:
A. Business Structure (Corporation, Joint Venture, Partnership); proper
incorporation by the Secretary of State and current Florida Professional
Registration Certificate for general contractor certification; name, address and
telephone number of firm.
B. Financial Statement - This statement will be an audited report with comments
and not older than one (1) year. If the most current report has not yet been
audited, the previous audited report with comment shall accompany the most
recent financial statement.
C. Submit Forms 254 and 255.
D. Years in business.
E. Express the general and specific project related capability of the in-house staff,
and indicate the adequate depth and abilities of the organization, which it can
draw upon as needed. Give brief resumes of key persons to be assigned to the
project including, but not limited to:
1) Name and title
2) Job assignment for other projects
3) Percentage of time to be assigned full time to this project
4) How many years with this firm
5) How many years with other firms
6) Experience

Methods for assuring subcontractors adherence to schedule should be
highlighted. A comparison of the firm's project profile should indicate their ability
to hold to original schedules and budgets.
1) Do you use or provide computer generated schedules for the
management of construction?
2) To what level of detail should a construction schedule be defined? How
do you schedule the processing of shop drawings?
3) How do you coordinate development of schedule information from
subcontractors?
4) State experience in handling crew loading and coordinated construction
scheduling.
5) State your experience in cost loading of schedules.
6) Attach a sample schedule which best illustrates your overall scheduling
capabilities.
L. Distance from site - location in miles of the proposed operating office to the
project site to be listed.
M. Name the person in charge of the proposed project. Please note, to receive
further consideration, at least one person assigned to this project must, within the
past five years, have conducted or assisted in the design and construction of
comparable facilities.
N. If a joint venture or prime/subcontractor arrangement of two firms, indicate how
the work will be distributed between the partners.
o. Describe how the organizational structure will ensure orderly communications,
distribution of information, effective coordination of activities and accountability.

P Describe the functions and capability of your computer-based project
management and information system.
Q. General and professional liability insurance company name and extent of
coverage.
R. Describe and explain any litigation, major disputes, contract defaults and liens in
the last ten years.
IV. INITIAL SCREENING (100 Points Total):
From the applicants' response to the ISQ, the Selection Committee will objectively
evaluate the firm's abilities in accordance with those criteria listed below:
A. Financial capability (15 points):
The firm's financial capability is to be expressed in the financial statement, and
should indicate the resources and the necessary working capital to assure
financial stability through to the completion of the project as outlined in III Band
III C. The financial capability should also include the bonding capacity of the
firm. (The firm will be required to bond on GMP).
B. Office Staff (15 points):
Outlined in III E and III F.
C. On-Site Staff (15 points)
Outlined in III G.
D. Related Building Experience (20 points)
Major consideration will be given to the successful completion of previous
projects comparable in design, scope and complexity as outlined in III J.
E. Scheduling and Cost Control (10 points):

F. Distance to Site (10 points):

V. INTERVIEWS (100 Points Total):
After the firms have been evaluated based on their written applications, the three
(3) firms with the highest scores will be more closely considered through a
presentation of their approach to perform this particular project. Time will be
allowed for questions and answers after the presentation. The selected firms will
be expected to address the following:
A. Appropriateness of prior projects and response of reference verifications
(20 points):
The firm should present details of those projects deemed most similar to
the proposed Aventura project. The presentation must include names and
phone numbers so that the project and references may be verified by City
staff.
B. Knowledge of the Site and Local Conditions (10 points):
The firm should demonstrate their knowledge of the site, local codes and
ordinances, local subcontractors and suppliers as an indication of their
ability to deliver quality workmanship in an effective and timely manner.
C. Proposed Project Staff and Functions (20 points):
The firms should name the actual staff to be assigned to this project,
describe their ability and experience and portray the function of each
within their organization and their proposed role on this project. The staff
should be present at the interview.
D. Overall Approach ard Methodology (20 points):
The firms should demonstrate verbally and/or graphically their plan for
performing this project, documenting the services to be provided and
showing the interrelationship of all parties.
E. Cost ControlNalue Engineering (10 points):
As part of its services, the firms should indicate knowledge and
experience in the evaluation of building systems, construction techniques

and the recommendations of materials to create an optimum value in
meeting the design requirements.
F. Scheduling this Project (20 points):
As part of the project approach, the applicants should propose a
scheduling methodology for effectively managing and executing the work
in the optimum time. The firm should indicate their procedure f.:>r
scheduling and for compliance controls. The firms should describe any
representative current projects and the projected, versus the actual,
schedule of each.
VI. TERMS AND CONDITIONS:
A. The City of Aventura reserves the right to accept or reject any proposal in
the best interest of the City.
B. The City of Aventura reserves the right to award the contract to the next
most qualified firm if the successful firm does not begin the contracted
services within the prescribed fifteen (15) days or if an acceptable fee
cannot be negotiated.
C. The successful firm shall not discriminate against any person in
accordance with federal, state and local law.
VII. SELECTION PROCESS:
A. The Selection Committee will review all proposal received on time and
determine the three (3) firms with the highest score using the selection
criteria established for the projec~
B. The Selection Committee will receive presentations or conduct phone
interviews of the three (3) highest scoring firms and will establish ratings
for each firm in accordance with the scoring criteria established for the
project.
C. The City Commission will consider and approve the order of the selection
of the firms based on the recommendation of the Selection Committee.
D. The contract for management, overhead and profit fee will be negotiated
with the firm selected by the City Commission.

lists and for getting paid by the Owner in a timely fashion without

from the best local subcontractors.
6) Construction Scheduling 0"
All of our staff are trained in the use of Primavera CPM scheduling
techniques. Scheduling is discussed in detail in Section K.
7) Quality Control (Design and Construction) 0"
Desil!:n Phase
Quality Control is maintained during the design phase by holding to
the desired materials, equipment and systems without sacrificing
quality. This is accomplished through very frequent and extensive
meetings of all members of the team. During the meetings, we
provide timely pricing of changes, methods and systems in order to
equip the Owner with proper information for decision making along
the way.
Quality Control is also maintained at this stage by the prequalifying
of subcontractors and suppliers prior to bidding to ensure that only
qualified, experienced and financially sound firms with excellent
reputations are permitted to submit bids.
Construction Phase
During the construction phase, quality control starts with the
checking of shop drawings to ensure full compliance with the Plans
and Specifications. This check also includes samples and mock-ups.
Weekly meetings will be held with the Owner, subcontractors, and
design representatives to discuss problems and the progress schedule
so that everyone is made aware of what they have to do to eliminate
problems and to stay on schedule. Quality Control procedures are
reviewed and emphasized at every meeting.
The Project Superintendent will be in the field all day, ensuring the

Constructability reviews are periodically made during the different
stages of the design phase and during the preparation of the various
interim estimates in order to provide input on proposed systems,
methods, materials, equipment and techniques. Our primary objective
is to stay within the Owner's budget while establishing construction
methods and techniques necessary to build the project in the shortest
timeframe without sacrificing quality or economy.
9) Cost Control 0'
Our cost control starts in the design phase. This is the time for
optimizing value while meeting the design requirements and staying
within budget constraints. We are very good at this. We have
extensive knowledge and experience in successfully accomplishing
these objectives using the Construction Management at Risk
process. Our own internal systems of estimating, cost control and
scheduling are very important, but we believe that the main key to

staying within the Owner's budget is timely communications and
weekly meetings with the entire team including ourselves, the
Owner, the actual user, the Architect and the Engineers.
We are not only Construction Managers, but we also have a long,
successful history as traditional bid contractors. As such, we always
know what things cost today and what the real street prices are.
When we estimate your project we do not rely on past prices. We go
to the local subcontractors and supplier market in line with today's
pnces.
During the construction phase we will continue our cost control
programs using Prolog Manager and Primavera software controls.
We continue to look for and initialize all possible savings and value
engineering to further reduce costs without sacrificing quality. Our
scheduling program and systems are also a major factor in controlling
costs during this phase by ensuring the completion of your project on
time without claims and costly litigation.
10) Change Order Negotiation 0
As previously stated, our experience provides us with extensive
knowledge of costs and supporting databases. We are very adept at
negotiating changes with Owners, Architects, Subcontractors and
Suppliers at any level. Our ability to accurately evaluate all quantities
and costs with the latest computer technology gives James A.
Cummings, Inc a distinct advantage in such negotiations. This results
in accurate and equitable compensation for changes while minimizing
extra costs for the Owner.
11) Claims Management 0
With our computerized scheduling system updated on a weekly basis,
we are able to track all changes and identify potential claims as they
may develop. Our objective is to not only manage claims in the best
interest of the Owner and ourselves, but also to mitigate them through
timely identification and resolution.

include early preparation of punch lists which are updated on a
continual basis; verification that the as-built plans are updated and

The $8 million dollar project consists of the construction of two seperate buildings comprising of a combined
building area of approximately 58,900 square feet on the +/- 8 acre site. Building A is a one story Fire/EMS
station with 9, I 00 square feet. It contains a two-bay apparatus/truck garage and living quarters for nine firemen.
Building B is a two-story Police Building with 49,800 gross square feet which includes a 4,000 square foot
community room at ground level.

architect with preconstruction estimating, scheduling and budget development in order to define the most
beneficial program that could be successfully performed under severe time and budget restraints. Value
engineering was initially performed to bring the projects into a very tight budget. Value engineering will

Cummings-Centex Rooney, ajoint venture between James A. Cummings, Inc. (lead partner) and Centex Rooney
Construction Co., Inc., was selected by Broward County as the Managing General Contractor for the construction
of a seven-story 4,800 car parking garage. The $62 million project includes other sub projects which include
raising of the airport surveillance radar tower (ASR), relocation of the FAA Remote Transmitter (RT) and
Remote Receiver (RR) and the installation of an airport wide Parking Access and Revenue Control System at the
five existing remote parking lots. This project is currently on schedule to be complete in September 1999.
This is the first Construction Manager at Risk project for Broward County. Our services on the project
have included (1) scheduling services, (2) constructability reviews, and (3) extensive Value Engineering
which reduced construction cost by more than $13 million. In addition to being on schedule with the
construction of the parking garage we are also working closely with the Program Manager and FAA to fast track

With work involving $18 million of new construction on four existing school campuses, the projects range in size

Metro-Dade Courthouse Center Interior Renovations

James A. Cummings, Inc. is currently performing interior renovation construction work as General Contractor to
Metro-Dade County. The $17.5 million dollar project is comprised of the renovation and remodeling of the
existing and occupied 257,000 square foot, 30-story building to accommodate the Family Courts Division of
the II th District Court. This work consists of the uemolition of several entire floors and the addition of
courtrooms, hearing rooms, holding cells, new data and communication systems, upgraded security and duress
systems, and also a new building management system which, when used in conjunction with the new HV AC
chilled water tie-in to the County's Central Plant, will help the building run more efficiently. All of this is being
done while trying to minimize any disruption to the building's occupants.
This project is currently on schedule with a completion date of December 1998. James A. Cummings, Inc.
maintains a full time field office on the project, in order to maintain project quality, cost, and schedule. One of
James A. Cummings, Inc.' s many services on this project included $1.8 million in value engineering
suggestions which enabled the project to come within the owner's established budget and allowed

SUBJECT: Commission Chambers/Cultural Center Design
The architects have asked for more direction with respect to the subject design. After
visiting several cities and viewing their commission chambers, I would make the
following suggestions for the design of the City of Aventura's Commission Chambers:
1. Create a "fixed" dais on an elevated stage.
2. Include an individual microphone system for the dais with a television monitor in
between every two seats for the purposes of viewing special presentation
materials.
3. Create a curtain to divide the dais from the chambers for other purposes.
4. The floor directly in front of the dais will serve as the area for a moveable stage
for cultural performances.
5. Create a fixed, auditorium-style seating in the audience with a slanted floor.
6. On the side of the chambers, position a large screen, which can be hidden by a
curtain, for the purposes of projecting presentation materials to the audience.
7. Create an audiovisual room directly behind this screen, where the projector and
sound system will be located.
8. Create a sloped ceiling with dramatic lighting.
As you suggested, with the opening of the AMC 24 Theater Complex, the City could
utilize this facility to hold large cultural events that require an upgraded sound system.
Smaller events could be held at the Government Center multi-purpose room and
meeting rooms. Therefore, the fixed dais concept could be utilized at the new
Government Center.
Attached are pictures taken from the commiSSion chambers in Cooper City and
Coconut Creek. These pictures reflect the type of design described in the above items.
