SUBJECT: Establishment of Reside Policy to Provide Priority to City
Residents for Utilization of City Parks
It is recommended that the City Council adopt the following policy to ensure resident
priority in the utilization of City parks and maintain the City's eligibility to accept grants
and outside funding sources to construct the park system:
1. All guests using City parks shall be required to obtain a guest pass and be
accompanied by a resident at all times. Guest passes shall be available
at the entrance gate to use the facilities no more than twelve (12) times
per year at a daily cost of $5.00 per adult visit and $3.00 per child visit
(ages 17 and under). Guest fees shall be waived if the guests are family
members of a resident.
2. Non-residents shall be permitted to use City parks, amenities, and
facilities on a space available basis only, and shall be subject to denial of
use.
3. Non-residents will be subject to the following usage fees:
Daily $ 5.00 for adults
Pass: $ 3.00 for children under 17
Monthly
Pass:
$ 100.00 for adults
$ 60.00 for children under 17
Annual
Pass:
$1,000.00 for adults
$ 500.00 for children under 17
4. Non-resident fees shall not apply to all permitted activities for the purpose
of City sponsored and approved special events, leagues, and activities.
5. Non-resident fees shall be in addition to any user fees established by the
City.

SUBJECT: Safe Neighborhood Parks Grant
Pursuant to our previous discussions regarding residency requirements of Aventura
Founders Park, I have researched the County Ordinance that governs the
aforementioned grant program.
Section 5Ia)(1) of the Ordinance states:
"Individual applications for grant or per capital allocations pursuant to Section 3
shall be submitted to the Committee for approval as to conformity with the
requirements of this Ordinance and for the Committee review and
recommendations. The application shall be accompanied by an authorizing
resolution from the governing body of the applicant Public Agency that the
project (or projects) for which the grant or allocation is sought is an important
park and recreation project (or projects) which will benefit all residents of
Dade County and that operation, management and programming funds are
included in budget".
Section 6(a)(4) of the Ordinance states:
"Any beach, park or other public facility acquired, developed, rehabilitated or
restored with funds from this act shall be open and accessible to the public
without discrimination as to race, color, gender, age, religious belief,
residence, national origin, marital status or disability."
Robin Pearsall, Budget Coordinator for the bond program contends that these sections
indicate that if the City elected not to allow non-residents to utilize Founders Park, the
entire project might be ineligible for grant funding. However, the use of non-resident
fees would not affect the eligibility of this project, as long as Dade County residents
would have access to the park.

Dear Mayor Snyder and Council Members:
I. Reauest For Leqal Opinion
You have asked us to research whether the City may restrict
access to a public park to City residents. For purposes of our
analysis, we have made the assumption that the park land was not
purchased by the City utilizing any federal or state funds that may
contain restrictions against the exclusion of non-residents.'
II. Opinion
Based upon our research of the matter and the authorities
cited below, it appears that generally a "resident only"
distinction may be made provided that the record contains specific
factual and policy declarations which demonstrate that the

restriction bears a rational relationship to legitimate municipal
goals of the City.
III. Leqal Analvsis
The Fourteenth Amendment to the U.S. Constitution provides
that no state shall deny to any person within its jurisdiction the
"equal protection" of the laws. The proper test to use in
determining whether a "resident only" restriction for the use of a
City park violates the equal protection clause is the "rational
relationship" test, i.e., a rational foundation for a distinction
between residents and non-residents must be shown in order to
sustain the distinction. Such a classification cannot discriminate
against a class of persons merely because they are non-residents of
a municipality. Citv of Maitland v. Orlando Bassmasters, 431 So.2d
178 (Fla.5th DCA 1983), AGO 074-279. However, under the "rational
relationship" test, the regulation is presumed valid and will not
be disturbed unless it lacks a reasonable relation to a valid
municipal purpose.
Although there are no cases directly on point in the State of
Florida, this issue has been addressed in other States.2
In Van Ness v. Borouoh of Deal, 367 A.2d 1191 (1976), the
Superior Court of New Jersey held that a regulation limiting the
use of municipally owned beach club facilities to residents of the
municipality did not deny equal protection. The City of Deal built
a municipal beach club facility consisting of a parking lot, an
olympic and infant's pool, changing facilities, restrooms,
bathhouses and cabanas, a snack bar, a restaurant, and recreational
facilities; including shuffleboard, ping pong, basketball and
tetherball. The construction of the facility was financed through
municipal revenues and bonds. The City limited access to the
facilities by allowing only residents to become members of the
beach club. In Van Ness the Court found that the City of Deal could
reasonably distinguish between residents and nonresidents in
providing access to the facility because (1) the facility had a
limited capacity; and (2) the facilities had been developed and
maintained through local taxes and bonds financed by residents.

opinions that parks are generally held for the general public not
for residents. However, those opinions refer to public coastal,
shoreline and beach front property which cannot be restricted
solely to residents based upon the "Public Trust Doctrine".

Similarly, in Zarooqian v. Town of Narraqansett, 701 F.Supp.
302 (D.R.I. 1988), the town of Narragansett (the "Town") restricted
use of the Canonchet Beach Facility to Town residents. The
facility consisted of cabanas, changing rooms, showers, kitchen
areas and a meeting room. Non-residents filed suit against the Town
claiming that denying them the opportunity to lease facilities at
Canonchet Beach violated the Equal Protection Clause of the United
States Constitution. The Court upheld the Town's residency
limitation observing that showers and changing rooms "by virtue of
their finite number must be restricted", in holding that limitation
on the use rationally furthered the aim of the Town to allocate the
limited number of rental facilities. The Court found that the
"rationing of this scarce resource was based on a rational premise"
as the Town's resident priority policy acted to secure an equitable
enjoyment of the individual beach facilities for the Town's
inhabitants.
On a similar issue the Supreme Court has held that an
ordinance restricting parking to residents did not, on its face,
violate the equal protection guarantee of the Fourteenth Amendment,
even though the ordinance discriminated between residents and
nonresidents. Count v Board of Arlinqton Countv. Va. v. Richards.
434 U.S. 5. (1977) In Arlinqton, the County adopted a zoning
ordinance which provided for the issuance of parking permits to
residents of designated residential areas, and which prohibited the
parking of an automobile without a permit in the designated areas.
The purpose of the ordinance was to stem the flow of commuter
traffic from commercial and industrial districts into adjoining
residential neighborhoods, and to reduce air pollution and other
environmental effects of automobile commuting. The Court found
that the goals of the ordinance were legitimate and that the
distinction drawn by the ordinance between residents and non-
residents rationally promoted the regulations's objective.
IV. Summary
In summary, while the law does generally permit
classifications which distinguish between residents and
nonresidents such classifications would need to be implemented by
adoption of an ordinance based upon specific legislative findings.
In creating a municipal park which limits access to residents, the
City must first justify its favored treatment of residents as the
municipalities did in the Van Ness and Zarooqian cases discussed
above. If the Council wants to proceed in this direction, the next
step would be to begin to identify specifically and in detail the
need for the regulation and the rational basis for it. We are
available to work with staff on this matter. In the meantime, if

AVENTURA SUMMARY VISION STATEMENT
The people of Aventura value the sense of community they get from living here. That
sense of community is strong and growing. However, that value is not readily apparent
in the physical environment. It is the presence and interaction of people that cause that
sense of community, and the presence and interaction of people that will cause the
physical image of the City and the self-image held by the people of Aventura to
change. Those changes will be subtle but over the next twenty years will become
readily apparent to even the first-time visitor. The people of Aventura will refine the
built environment into a place that beautifully reflects their sense of community and will
continue to enhance the image of the City.
The evolving Aventura will be a source of great local pride. Picture a beautifully
landscaped, well-maintained and tree-lined road network with decorative streetlighting
that will provide an excellent means for mobility on a clearly defined hierarchy of
regional and local roads and streets. The City will be a leader in multi-modal
transportation with a clean and efficient local transit system, and an extensive.
connected network of bicycle and pedestrian facilities.
There will be a major City Center and a local Village Center. The City Center will
include a pedestrian-friendly esplanade, a Government Center, and a well-landscaped
passive and active park. The City Center will greatly enhance Aventura's sense of
place. The Village Center will be comprised of the Loehman's Plaza area and NE 18S1h
Street, 1871h Street and 1881h Street. Small shops, restaurants and entertainment will
be the main theme of the Village Center.
Parks and cultural centers for seniors, teens and young families will be constructed.
Economic growth will playa key role in guiding development and will successfully
attract new businesses, nightlife, and a medical campus. The City will take an active
role in collaborating with the Dade County school system to provide educational
opportunities for city residents. The lasting image Aventura will leave on visitors and
residents will be one of tropical comfort and sophistication.
Aventura will be known as having an excellent police force, a highly advanced system
of night lighting, and effective crime prevention through environmental design features.
The City will boast one of the lowest crime rates in Florida. An extensive investment in
stormwater management and infrastructure facilities will be made to greatly improve
surface drainage and water quality.
The combination of tree-lined boulevard~ and pedestrian paths will lead to the City
Center and commercial centers where citizens will meet, make decisions, talk work.
shop, learn, eat and come together to relax and enjoy life. This is the Aventura that
people will build: a place that promotes and supports the interaction of people as a true
community.
Aventura will be the place to be and maintain its image for a high quality of life for

It was with great interest that I read the advertisement for A ventura residents to serve on
the Cultural and Recreation Advisory Board. With my A ventura address for the past 15
years and over 18 years of special events marketing experience, I feel that I can make
substantial contributions and be a valued, working member of the Board
A~ the director of special events marketing for Mount Sinai Medical Center, I am
responsible for all of the events for various markets. Similar to our Aventura community,
our market crosses various age groups, so each event is planned accordingly. For example,
I recently orchestrated a very successful singles event at a popular new hotel, planned a
family day picnic at FlU and am in the process of doing a theater and dinnel party for a
more senior group at the Jackie Gleason Theater.
For every event, I effectively handle all of the details. This includes contracting the facility,
designing the invitations, advising media, catering, transportation, handling special needs,
gifts for guests and write the remarks for speakers. I have been told that I have a knack of
coming up with exciting events-- and promoting them in a way that makes people really
want to participate. And most of all, they enjoy the experience long after the event is over.
Through my position here at Mount Sinai, and through my previous positions, I have
developed many rewarding contacts. I am able to utilize this network to plan events that
are either underwritten or produced for a very reasonable cost. I strive to produce high
enjoyment events at a low expense---which works out to everyone's advantage.
It would be a privilege to put my event skills, energy and spirit of teamwork to work for
the City of Aventura. I am very proud to live in Aventura, and would deeply appreciate
this opportunity to be a part of its dynamic growth and achievements.

I would like to apply for appointment to the Cultural and Recreation
Advisory Board of the City of Aventura. I am a 51 year-old physician, an
Aventura resident since March,1994. My wife and I presently reside in our home
in the Island Way section of the Waterways. I am a Radiologist , and have
practiced at Cedars Medical Center in Miami for over 19 years, my wife is a
teacher at the Jacobson Sinai Academy Day School of Temple Sinai.
I have always had great interest in the responsibilities inherent in this
position. I have held significant leadership positions in community
organizations which play very important roles in the delivery of cultural,
educational and recreational programming to Northeast Dade. From 1980 to
1982, I served as President of the Board of the Michael-Ann Russell J.C.C., and
from 1992 to 1994 as President of the Board of Temple Sinai of North Dade. I
still serve on the Sinai Board as Immediate Past President. Among my
activities at the JCC was organizing and serving as the host of a very
successful arts event fundraiser held at the Intercontinental Hotel in Miami, at
which Yaacov Agam was a surprise guest.
I have been listed in Who's Who in the South and Southwest, Who's Who in
the World, and Who's Who of Emerging Leaders in America, all published by
Marquis Who's Who.

In response to your request please consider my qualifications for service on the Cultural and
Recreation Advisory Board.
A resident of Dade County since 1947, I moved to Tumberry in April of 1997. My life long
interest in cultural arts -- classical music, ballet, opera, art, and theater -- has been the motivation
for community service through the years in South Florida.
In the 1960s I worked with 10hn Bitter when he organized the first local symphony orchestra, in
residence at the University of Miami. I then served as a Board Member for the original Miami
Philharmonic Symphony Orchestra directed by Fabian Sevitsky. I was honored to host the
farewell party for Dr. Sevitsky in my home as he passed the baton on to Alain Lombard. I
continued to serve on the board during Maestro Lombard's brief tenure.
During that same era I hosted the founding organizational meeting for the Miami Ballet Society at
my home. At that time Thomas Armour and his Miami Ballet, a regional company, provided the
foundation for the core of dedicated balletomanes who eventfully brought us to the level of
professionalism now available.
I have been a long time supporter and personal friend of ludy Drucker, and am a patron of the
Metropolitan Opera of New York. My work as a board member of Temple Emanuel, and on
countless conunittees for the organization of special fund-raising events has given me the
experience of working cooperatively and effectively with peers and support staff.
I hope that I can now bring that experience to serve on the A ventura Cultural and Recreation

Is owned by the CIty of Miami Beach and operated by the COncert Association of
florida. ThIs Theater had been closed for some time and the CIty chose the COncert
Association to operate it. We bad a subsidy from the CIty plus we were able to
secure grants from the State for Capitol Improvements. ThIs has become a favorite
the for smaB performing arts, non prolt groups. We had organized a sliding scale of
rental fees , which made it very affordable for these many groups. With rental night
growing to over 200 night per year. I also created a space for a smaB restaurant,
which assisted In bringing In additional revenues with the goal of eliminating the
CitIes subsidy.
1986-1989- Director of SpedaI gifts for the Coconut Grove Playhouse. Doing fund
raising through COrporate and personal donor support. Also created many spedal
events for additional revenues.
I opened a second stage now called the Encore Room. ThIs space was standing
Vllcant for many years. It houses smaB shows, Jazz club etc.
1981- 1983 seacoast Towers Rental Apartmems. Miami Beach. DIrector of Rental of
this 5 building COmplex. During this time I created a Apartment Hotel within the
COmplex to assist with the ~ Rental market Due to the success with this project
the owner re directed myetJorts to creating The Alexander All Suite Hotel. form
1983-1986 1 managed the Alexander Hotel and opened Dominique's Restaurant of
washington DC fame. i986 the Hotel was sold
1979-1981. Managing Director of The Palms on the Ocean Hotel. which housed the
Pritlken Longevity Center.
1975.1981 Manager of The Pontainebleau Hotel later to be called the
Fontainebleau Hilton. Managed this Hotel though very difficult financial times. The
tourist marlret had decUned and major conventions did not look. on Miami Beach
with favor. I did an extensive 1IllU'k.e1ing survey and decided the only hope for
filing those 1200 room was in developing business from Europe and SOuth
America. After extensive travel throughout Western Europe and SOuth America I
created packages with the airlines and Wholesale tour Operators. Was also
inftueotial in creating inauaragal Plights into Miami from London ,Paris and
Germany. Also dealt with Charter operators which brought in thousands of tourists
from these countries.
1979 the owner of the Fontainebleau brought in a major chain to operate the
Hotel. I continued on with HIlton till 1981 and chose to leave.
1970-1975
General Manager of the Eden Roc Hotel which closed in 1975, until it was sold in
later years.

SUBJECT: Zoning Notification Process
Recently, several members of the City Council expressed concern regarding the
notification process for zoning hearings. Attached is the section of the City Ordinance
that relates to the notification process that is utilized by the City.
Upon reviewing this matter, it appears the problem exists when the City takes action to
postpone an item on the Agenda and continue the matter to another meeting. The
affected property owners are not re-noticed.
In order to correct this situation, I would recommend that when an item is continued to
another meeting, the applicant should pay the costs of re-noticing the property owners.

amendments to the provisions of Chapter 33 "Zoning" of the County Code as applicable to
the City of Aventura pursuant to Section 8.03 of the City Charter.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF AVENTURA, FLORIDA, AS FOLLOWS:
Section 1.
Public Hearina: Notice of HearinQ.
A. When an application, as prescribed by Section 33-304,33-309 and 33-314 of
the County Code, is filed, it shall promptly be set for public hearing before the City Council.
B. Written recommendations of the City Manager or his designee shall be
developed and such recommendation shall become a part of the hearing file and record,
and open for public inspection.
C. Notice of the time and place of the public hearing describing the nature of the
application and street address of the property shall be published in a newspaper of general
circulation in the City not less than 10 days prior to the public hearing.
D. A courtesy notice containing substantially the same information set forth in
the published notice may be mailed to the property O'M1ers of record located within a radius
of 300 feet of the property described in the application or such greater distance as the City
Manager may prescribe; provided, hOll".lever, that failure to mail or receive such courtesy
notice shall not affect action or proceedings taken under this Section.
E. The property shall be posted no later than 10 days prior to the hearing in a
manner conspicuous to the public, by a sign or signs containing information concerning the

application including but not limited to the applied for zoning action and the time and place
of the public hearing.
F. All costs of advertising, mailing and posting shall be bome by the applicant.
Section 2. City Zonina Officials and Authorities: Provisions in Effect.
A.
(1 )
Chapter 33 "Zoning" of the County Code, as made applicable to the
City pursuant to the provisions of Section 8.03 of the City Charter, is hereby amended to
substitute the City Council in the place and stead of County boards and committees,
included but not limited to the Board of County Commissioners and the Zoning Appeals
Board, so that all zoning variances, special exceptions, unusual uses, appeal of
administrative action and other quasi-judicial action otherwise required to be taken by such
boards or committees at a public hearing shall be taken by the City Councilor by any
person or board delegated such authority by the City Council by ordinance.
(2) Chapter 33 "Zoning" of the County Code, as made applicable to the
City pursuant to the provisions of Section 8.03 of the City Charter, is hereby further
amended to substitute the City Manager or his designee in the place and stead of all county
officials, including but not limited to the Director of Planning, Development and Regulation,
so that all zoning review of building permit applications and all other action which would
otherwise be taken by such County officials shall be taken by the City Manager or his
designee. The City staff under the direction of the City Manager shall perform those
functions for the City as may be designated by the City Manager.

fortunetelling establishment, pending presemation and consideration of this
occupational license tax rate dispute to the City Council. We provided this advice
to the City on October 9, 1997, and the City has acted in accordance with such
advice. Occupational license taX enforcement concerning Nicholas' fortunetelling
business at 20520 Biscayne Boulevard will not be undertaken until final efforts
to amicably conclude this matter are resolved. Accordingly, this enables the
fortunerelling establishtnem to continue to operate at the 20520 Biscayne
Boulevard address;
2. This letter shall serve to confirm to Miami-Dade County (the "County")
Occupational license Tax Division, Departtnent of Revenue Collection, that the
City of Avenmra has no objection to and consents to the issuance of the County
occupational license to Julia Nicholas for the fortunetel!ing business conducted at
20520 Biscayne Boulevard, A ventura, Florida, for the occupational license tax
period which commenced on October 1, 1997;
3. We recognize that the State D.O. T. is in the process of acquiring the lands at
20520 Biscayne Boulevard. Accordingly, any relocation of the fortunetelling
establishment from 20520 Biscayne Boulevard to any other location within the
City of Avenmra, will be governed by the provisions of the Zoning District
regulations which are applicable within the City, as such regulations are presently
in effect or as hereafter revised in accordance with law.
We trust that you will avail yourself of the above described administrative remedy, and
would encourage you to make a further effort to resolve this matter with us before embarking
upon the path of litigation.
