AN ORDINANCE OF THE CITY OF AVENTURA, FLORIDA AMENDING
ARTICLE III "ADVISORY BOARDS" OF CHAPTER 2
"ADMINISTRATION" OF THE CITY CODE BY AMENDING SECTION 2-
191 "CREATION AND COMPOSITION" BY AUTHORIZING THE CITY
MANAGER TO INCREASE THE SIZE OF THE BOARD WHEN
NECESSARY AND REMOVING THE RESIDENCY REQUIREMENT FOR
BOARD MEMBERS; PROVIDING FOR SEVERABILITY; PROVIDING
FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City Commission of the City of Aventura, Florida (the "City") finds
it periodically necessary to amend its Code of Ordinances (the "City Code") in order to
update regulations and procedures to implement municipal goals and objectives; and
WHEREAS, the City Commission desires to amend Chapter 2 "Administration,"
Article III "Advisory Boards" by amending Section 2-191 to provide for greater flexibility
with concerning the appointment of board members to the newly -created Arts in Aventura
Board; and
WHEREAS, the City Commission has held the required public hearings, duly
noticed in accordance with the law; and
WHEREAS, the City Commission has reviewed the action set forth in this
Ordinance and has determined that such action is consistent with the City Code of
Ordinances.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF AVENTURA, FLORIDA, THAT:
Section 1. Recitals Adopted. Each of the above stated recitals is hereby
adopted and confirmed.
Section 2. City Code Amended. Chapter 2 "Administration," Article III
"Advisory Boards" of the City Code of Ordinances is hereby amended as follows:'

Division 5. - Arts in Aventura Board
Sec. 2-121. - Creation and Composition.
(a) There is hereby created and established the Arts in Aventura Advisory Board (the
"Board") consisting of five (5) members no more than seven (7) members, who shall
be appointed by the Mayor, subject to the approval of the City Commission.
Members will be appointed for a term of two years and may serve multiple terms.

;,TtMeRt. Preference will be given to City residents, though residency is not a
prerequisite to appointment as the City desires to appoint individuals to serve on the
Board who possess the necessary skills, knowledge and ability regardless of
residency.
Section 3. Severability. The provisions of this Ordinance are declared to be
severable and if any section, sentence, clause or phrase of this Ordinance shall for any
reason be held to be invalid or unconstitutional, such decision shall not affect the validity
of the remaining sections, sentences, clauses, and phrases of this Ordinance but they
shall remain in effect, it being the legislative intent that this Ordinance shall stand
notwithstanding the invalidity of any part.
Section 4. Inclusion in the Code. It is the intention of the City Commission,
and it is hereby ordained that the provisions of this Ordinance shall become and be made
a part of the Code of the City of Aventura; that the sections of this Ordinance may be
renumbered or re -lettered to accomplish such intentions; and that the word "Ordinance"
shall be changed to "Section" or other appropriate word.
Section 5. Effective Date. This Ordinance shall be effective immediately upon
adoption on second reading.

The foregoing Ordinance was offered by Commissioner Friedland, who moved its
adoption on first reading. The motion was seconded by Commissioner Kruss, and upon
being put to a vote, the vote was as follows:
