Page 2 of 2 DON SOFFER $AVENTURA HIGH CHOOL AVENTURA GOVERNING BOARD AVENTURA CITY OF EXCELLENCE SCHOOL AND DON SOFFER AVENTURA HIGH SCHOOL REGULAR MEETING MINUTES JANUARY 22, 2026 9:00 a.m. Aventura Government Center 19200 West Country Club Drive Aventura, FL 33180 Aventura City Commission acting in its capacity as the Governing Board for the Aventura City of Excellence School (ACES) and the Don Soffer Aventura High School (DSAHS): 1. CALL TO ORDER/ROLL CALL: The meeting was called to order by Mayor Howard Weinberg at 9:05 a.m. The roll was called and the following were present: Mayor Howard S. Weinberg, Vice Mayor Amit Bloom, Commissioner Clifford B. Ain, Commissioner Gustavo Blachman, Commissioner Rachel S. Friedland, Commissioner Paul A. Kruss, Commissioner Cindy Orlinsky, City Manager Bryan Pegues, City Clerk Ellisa L. Horvath, and City Attorney Robert Meyers. Also present were ACES Principal Dr. Andrea Beck, DSAHS Principal Dr. Geoff McKee, Rachel Windler-Freitag — Charter Schools USA Vice President Research, Development and Innovation, and Rita Weaver - Charter Schools USA Senior Director of Board Governance. As a quorum was determined to be present, the meeting commenced. 2. PLEDGE OF ALLEGIANCE: The Pledge was led by Mayor Weinberg. 3. APPROVAL OF MINUTES: A motion for approval of the September 18, 2025 Aventura Governing Board Regular Meeting Minutes was offered by Vice Mayor Bloom, seconded by Commissioner Orlinsky, and passed unanimously by roll call vote. 4. SCHOOL UPDATES: • Aventura City of Excellence School (ACES): Principal Dr. Andrea Beck provided updates including the following items: enrollment/waitlist, National Junior Honor Society induction, Middle School athletics, parent programs, ESAC Board Chair, and upcoming events. The City Commission provided input on the items including: positive comments on the book focused event "Don't Feed the Lion," the proper process for addressing bullying at school, and working on a lower price for the gap time between when school ends and activities begin at the recreation center. Consensus was provided for Mr. Pegues to come back with a plan for addressing the gap time. Aventura Governing Board Regular Meeting Minutes Aventura City of Excellence School and Don Soffer Aventura High School January 22, 2026 Mr. Meyers reporting on the anti -bullying statute. Principal Dr. Beck provided responses to questions asked. No comments were provided by members of the public. • Don Soffer Aventura High School (DSAHS): Principal Dr. Geoff McKee provided updates including the following items: learning event at the Aventura Turnberry Jewish Center for Holocaust Remembrance Week, School Resource Officer Mike retirement event, new School Resource Officer Chris, testing (PSAT etc.), programs, Florida Department of Education honors, upcoming production of Grease, University of Cambridge graduations/diplomas, college admission process, and enrollment. The City Commission provided input on the items including: progress of the new guidance counselor and college advisor, enrollment/waitlist, increasing student capacity, college applications/scholarships, Florida's great state university program, more support in the college department, and test preparation. Principal Dr. McKee provided responses to questions asked. No comments were provided by members of the public. 5. APPROVAL OF 2026-2027 SCHOOL CALENDAR FOR ACES AND DSAHS: Mayor Weinberg introduced the item. A motion for approval was offered by Commissioner Kruss and seconded by Vice Mayor Bloom. Mr. Pegues reported on the alignment of the two school calendars as previously requested by the Board. The City Commission commented on the item including further review of the calendars regarding scheduling closures on certain Fridays before holidays falling on Mondays to alleviate student absences. Ms. Windler-Freitag, Ms. Weaver, Principal Dr. McKee and Principal Dr. Beck provided input. No comments were provided by members of the public. The motion for approval passed (6-1), with Commissioner Friedland voting no, by roll call vote, with a request for further review. Mr. Pegues will follow up on the item at a future meeting. APPROVAL OF OUT -OF -FIELD WAIVER FOR ACES: Mayor Weinberg introduced the item. A motion for approval was offered by Vice Mayor Bloom and seconded by Commissioner Friedland. Ms. Windler-Freitag reviewed the item. The City Commission provided positive comments on having only one waiver. No comments were provided by members of the public. The motion for approval passed unanimously by roll call vote. 7. REVIEW OF FALL SURVEY RESULTS FOR ACES AND DSAHS: Mayor Weinberg introduced the item. A motion for approval was offered by Commissioner Friedland and seconded by Vice Mayor Bloom. Ms. Weaver reviewed the Aventura Schools CSUSA 2025-2026 Fall Stakeholder Satisfaction Surveys including the following: Survey Scale & Interpreting the Results, Constructs Measured Across Each Stakeholder Group, City of Aventura Commission Survey Participation Summary for ACES & DSAHS, ACES (Summary Results by Category, Historical Parent Survey Results, Historical Staff Survey Results, Historical Student Survey Results), and DSAHS (Summary Results by Category, Historical Parent Survey Results, Historical Staff Survey Results, Historical Student Survey Results). The City Commission provided comments. No comments were provided by members of the public. The motion for approval passed unanimously by roll call vote. 8. OTHER BUSINESS: None. 9. Attachment CITY OF AVENTURA ORDINANCE NO. 2026- AN ORDINANCE OF THE CITY OF AVENTURA, FLORIDA, ADOPTING THE ATTACHED AVENTURA CITY OF EXCELLENCE SCHOOL OPERATING AND CAPITAL BUDGET FOR FISCAL YEAR 2026/2027 (JULY 1 — JUNE 30), PURSUANT TO SECTION 4.05 OF THE CITY CHARTER; AUTHORIZING EXPENDITURE OF FUNDS ESTABLISHED BY THE BUDGET; PROVIDING FOR BUDGETARY CONTROL; PROVIDING FOR PERSONNEL AUTHORIZATION; PROVIDING FOR GIFTS AND GRANTS; PROVIDING FOR AMENDMENTS; PROVIDING FOR ENCUMBRANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF AVENTURA, FLORIDA, AS FOLLOWS: Section 1. The 2026/2027 Operating and Capital Improvement Program Budget for the Aventura City of Excellence School, a copy of said budget being attached hereto and made a part hereof as specifically as if set forth at length herein, be and the same is hereby established and adopted. Section 2. Expenditure of Funds Appropriated in the Budget Authorized. Funds appropriated in the Budget may be expended by and with the approval of the City Manager in accordance with the provisions of the City Charter and applicable law. Funds of the City shall be expended in accordance with the appropriations provided in the Budget adopted by this Ordinance and shall constitute an appropriation of the amounts specified therein. Supplemental appropriations or the reduction of appropriations, if any, shall be made in accordance with Section 4.07 of the City Charter. Section 3. Budgetary Control. The Budget establishes a limitation on expenditures by department total. Said limitation requires that the total sum allocated to the Charter School Fund may not be increased or decreased without specific authorization by a duly -enacted Resolution affecting such amendment or transfer. Therefore, if requested by the Principal of the Aventura City of Excellence School, the City Manager may authorize transfers from one individual line item account to another, so long as the line item accounts are within the same department and fund. Section 4. Personnel Authorization. The "Personnel Allocation Summary" enumerates all authorized budgeted positions. However, if requested by the Principal of the City of Aventura Ordinance No. 2026- Aventura City of Excellence School, the City Manager may amend said authorized budgeted positions in order to address the operating needs of the department so long as sufficient budgeted funds are available. Section 5. Grants and Gifts. When the City of Aventura receives monies from any source, be it private or governmental, by Grant, Gift, or otherwise, to which there is attached as a condition of acceptance any limitation regarding the use or expenditures of the monies received, the funds so received need not be shown in the Operating Budget nor shall said budget be subject to amendment of expenditures as a result of the receipt of said monies, but said monies shall only be disbursed and applied toward the purposes for which the said funds were received. To ensure the integrity of the Operating Budget, and the integrity of the monies received by the City under Grants or Gifts, all monies received as contemplated above must, upon receipt, be segregated and accounted for based upon generally accepted accounting principles and where appropriate, placed into separate and individual trust and/or escrow accounts from which any money drawn may only be disbursed and applied within the limitations placed upon the Gift or Grant as aforesaid. Section 6. Amendments. Upon the passage and adoption of the Charter School Fund Budget for the City of Aventura, if the City Manager determines that the Department Total will exceed its original appropriation, the City Manager is hereby authorized and directed to prepare such Ordinances as may be necessary and proper to modify any line item from the Budget hereby. Section 7. Encumbrances. All outstanding encumbrances on June 30, 2026 shall lapse at that time; and all capital outlay encumbrances and/or capital outlay expenditures not spent during the fiscal year may be re -appropriated in the 2026/2027 fiscal year. Section 8. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 9. Effective Date. This Ordinance shall be effective immediately upon adoption on second reading. Attachment CITY OF AVENTURA ORDINANCE NO. 2026- AN ORDINANCE OF THE CITY OF AVENTURA, FLORIDA, ADOPTING THE ATTACHED DON SOFFER AVENTURA HIGH SCHOOL OPERATING AND CAPITAL BUDGET FOR FISCAL YEAR 2026/2027 (JULY 1 — JUNE 30), PURSUANT TO SECTION 4.05 OF THE CITY CHARTER; AUTHORIZING EXPENDITURE OF FUNDS ESTABLISHED BY THE BUDGET; PROVIDING FOR BUDGETARY CONTROL; PROVIDING FOR PERSONNEL AUTHORIZATION; PROVIDING FOR GIFTS AND GRANTS; PROVIDING FOR AMENDMENTS; PROVIDING FOR ENCUMBRANCES; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF AVENTURA, FLORIDA, AS FOLLOWS: Section 1. The 2026/2027 Operating and Capital Improvement Program Budget for the Don Soffer Aventura High School, a copy of said budget being attached hereto and made a part hereof as specifically as if set forth at length herein, be and the same is hereby established and adopted. Section 2. Expenditure of Funds Appropriated in the Budget Authorized. Funds appropriated in the Budget may be expended by and with the approval of the City Manager in accordance with the provisions of the City Charter and applicable law. Funds of the City shall be expended in accordance with the appropriations provided in the Budget adopted by this Ordinance and shall constitute an appropriation of the amounts specified therein. Supplemental appropriations or the reduction of appropriations, if any, shall be made in accordance with Section 4.07 of the City Charter. Section 3. Budgetary Control. The Budget establishes a limitation on expenditures by department total. Said limitation requires that the total sum allocated to the Don Soffer Aventura High School Fund may not be increased or decreased without specific authorization by a duly -enacted Resolution affecting such amendment or transfer. Therefore, if requested by the Principal of Don Soffer Aventura High School, the City Manager may authorize transfers from one individual line item account to another, so long as the line item accounts are within the same department and fund. Section 4. Personnel Authorization. The "Personnel Allocation Summary" enumerates all authorized budgeted positions. However, if requested by the Principal of Don City of Aventura Ordinance No. 2026- Soffer Aventura High School, the City Manager may amend said authorized budgeted positions in order to address the operating needs of the department so long as sufficient budgeted funds are available. Section 5. Grants and Gifts. When the City of Aventura receives monies from any source, be it private or governmental, by Grant, Gift, or otherwise, to which there is attached as a condition of acceptance any limitation regarding the use or expenditures of the monies received, the funds so received need not be shown in the Operating Budget nor shall said budget be subject to amendment of expenditures as a result of the receipt of said monies, but said monies shall only be disbursed and applied toward the purposes for which the said funds were received. To ensure the integrity of the Operating Budget, and the integrity of the monies received by the City under Grants or Gifts, all monies received as contemplated above must, upon receipt, be segregated and accounted for based upon generally accepted accounting principles and where appropriate, placed into separate and individual trust and/or escrow accounts from which any money drawn may only be disbursed and applied within the limitations placed upon the Gift or Grant as aforesaid. Section 6. Amendments. Upon the passage and adoption of the Don Soffer Aventura High School Fund Budget for the City of Aventura, if the City Manager determines that the Department Total will exceed its original appropriation, the City Manager is hereby authorized and directed to prepare such Ordinances as may be necessary and proper to modify any line item from the Budget hereby. Section 7. Encumbrances. All outstanding encumbrances on June 30, 2026 shall lapse at that time; and all capital outlay encumbrances and/or capital outlay expenditures not spent during the fiscal year may be re -appropriated in the 2026/2027 fiscal year. Section 8. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 9. Effective Date. This Ordinance shall be effective immediately upon adoption on second reading. CHARTER SCHOOLS® USA Internet Acceptable Use and Safety Policy 1.0 Purpose The purpose of this policy is to outline the acceptable use of computer equipment at Charter Schools USA (CSUSA) and CSUSA managed charter schools on behalf of the governing boards. These rules are in place to protect the employee and students of CSUSA. Inappropriate use exposes CSUSA to risks including virus attacks, compromise of network systems and services, and legal issues. Effective security is a team effort involving the participation and support of every CSUSA employee and affiliate who deals with information and/or information systems. Moreover, it is the responsibility of every computer user to know these guidelines and to conduct their activities accordingly. 2.0 Scone This policy provides guidelines that apply to all users of computer systems and services, no matter where the users are located. The term "users" refers to all employees, independent contractors, persons, or entities accessing CSUSA computer systems and services. All employees, students, contractors, consultants, temporary, and other workers at CSUSA and its subsidiaries are responsible for exercising good judgment regarding appropriate use of information, electronic devices, and network resources following CSUSA policies and standards, and local laws and regulation. This policy applies to technology administered in individual schools, the resources administered by central teams and departments, personally owned computers and devices connected by wire or wireless to the school network, and to off -site computers that connect remotely to the school's network services. 3.0 Polia 3.1 General Use and Ownership • It is the policy of CSUSA to (a) prevent user access over its computer network to, or transmission of, inappropriate material via Internet, electronic mail, or other forms of direct electronic communications; (b) prevent unauthorized access and other unlawful online activities; (c) prevent unauthorized online disclosure, use, or dissemination of personal identification information of minors; and (d) comply with the Children's Internet Protection Act [Pub. L. No. 106-554 and 47 USC 254(h)]. • Computers and computer accounts are provided to assist users in the performance of their jobs or functions with CSUSA. Users should have no expectation of privacy in anything created, sent, received, or downloaded on the computer or communication system. • All CSUSA users must obtain proper authorization to use computers, computer accounts, and computer files. Internet Acceptable Use and Safety Policy Page 1 of 9 CHARTER SCHOOLS® USA • The computer and communication systems belong to CSUSA and should be used for business and educational purposes only. CSUSA reserves the right to monitor the operation of these systems, to access all records within them, and to retain or dispose of those records as it deems necessary. • Users must comply with all software licenses, copyrights, and all other state and federal laws governing intellectual property. • All internet data that is composed, transmitted, or received via the CSUSA's computer communications systems is considered to be a part of the official records of CSUSA and, as such, is subject to disclosure to law enforcement or other third parties. Consequently, employees should always ensure that the business information contained on websites they view, email messages, and other transmissions is accurate, appropriate, ethical, and 1 awful . • The computer and communication systems belong to CSUSA and should be used for business purposes only. CSUSA reserves the right to monitor the operation of these systems, to access all records within them, and to retain or dispose of those records as it deems necessary. • A user is responsible for all activities originating from their account(s), including all information sent from, intentionally requested, solicited, or viewed from their account(s) and publicly accessible information placed on a computer using their account(s). 3.2 Student Data Privacy — COPPA. FERPA. and Florida Law COPPA Compliance. CSUSA complies with the Children's Online Privacy Protection Act (COPPA), 15 U.S.C. §§ 6501-6506. Where school -directed use is required, CSUSA schools shall act as the consent agent on behalf of parents as permitted under the FTC COPPA Rule (16 CFR Part 312). All digital tools used with elementary -age students shall be reviewed annually to ensure COPPA compliance. Teachers and staff may not independently enroll students under 13 in any third -party online service without prior approval from the CSUSA ITSS Department. • Florida Student Data Privacy Act (F.S. 1002.222). CSUSA complies with the Florida Student Data Privacy Act, F. S. 1002.222. All contracts with third -party vendors who access, store, or process student data must include provisions prohibiting the vendor from using student data for any purpose other than providing the contracted educational service; requiring data destruction timelines upon contract termination; and requiring the vendor to notify CSUSA of any data breach within 30 days of discovery, consistent with Florida breach notification law (F.S. 501.171). CSUSA shall maintain a student data inventory, updated at least annually, identifying all vendors and systems that collect, process, or store student data. Prohibited Use of Unauthorized Cloud Storage. Staff and students are prohibited from storing student personally identifiable information (PII) or educational records in unauthorized personal cloud storage accounts, including but not limited to personal Google Drive, Dropbox, or iCloud accounts. Student data must only be stored in CSUSA-issued or CSUSA-approved platforms (e.g., school -issued Google Workspace for Education, Microsoft 365). Storing student records in personal cloud accounts constitutes a violation of FERPA and this policy, and may result in disciplinary action up to and including termination Internet Acceptable Use and Safety Policy Page 2 of 9 CHARTER SCHOOLS® USA of employment. EdTech Application Approval. Prior to using any new digital tool, application, or online platform with students, teachers and staff must obtain approval from the CSUSA ITSS Department or designated Instructional Technology representative. The use of free, consumer -grade tools or applications with students is prohibited without prior review and written approval. This requirement applies regardless of whether the tool is accessed via web browser, mobile app, or other means. Staff who independently sign up for third -party services using school email addresses on behalf of students, without prior approval, may be creating unauthorized data sharing arrangements in violation of FERPA and applicable state law. 3.3 Security and Pro rip etary Information • System -level and user -level passwords must comply with CSUSA Password Policy. Providing access to another individual, either deliberately or through failure to secure its access, is prohibited. The following minimum password standards apply to all CSUSA accounts: (a) passwords must be a minimum of 8 characters in length; (b) default or vendor -supplied passwords must be changed immediately upon first use; and (c) passwords must never be written down or stored in an unsecured location. • Multi -Factor Authentication (MFA). MFA is required for all staff accessing CSUSA administrative systems, email platforms, and any system containing student data. Staff may not disable or bypass MFA on any CSUSA-managed account or system. Questions regarding MFA enrollment should be directed to the CSUSA ITSS Department. • Authorized CSUSA computer users are responsible for maintaining the security of their passwords and may not share accounts with any other individuals. • All computing devices must be secured with a password -protected screensaver with the automatic activation feature set to 15 minutes or less. You must lock the screen or log off when the device is unattended. • Employees must use extreme caution when opening e-mail attachments received from unknown senders, which may contain malware. • Use encryption on devices and systems where feasible and as directed by the CSUSA Cybersecurity and Infrastructure team and other applicable CSUSA policies. • Remote Access and Public Network Prohibition. Staff are prohibited from accessing, transmitting, or working with student personally identifiable information (PII) or any CSUSA administrative systems over a public or unsecured Wi-Fi network (including but not limited to coffee shops, hotels, airports, and other public hotspots) unless connected through a CSUSA-issued VPN. All remote access to internal CSUSA systems must be conducted via a CSUSA-approved VPN connection. Use of personal or third -party VPN services does not satisfy this requirement. Staff who require remote access must contact the CSUSA ITSS Department to obtain and configure the approved VPN client prior to working remotely. 3.4 Unacceptable Use. • Under no circumstances is a CSUSA user authorized to engage in any activity that is Internet Acceptable Use and Safety Policy Page 3 of 9 CHARTER SCHOOLS® USA illegal under local, state, federal, or international law while utilizing CSUSA owned resources. The lists below are by no means exhaustive but attempt to provide a framework for activities that fall into the category of unacceptable use. • To the extent practical, technology protection measures (or "Internet filters") shall be used to block or filter Internet, or other forms of electronic communications, access to inappropriate information. Specifically, as required by the Children's Internet Protection Act, blocking shall be applied to visual depictions of material deemed obscene or child pornography, or to any material deemed harmful to minors. Subject to staff supervision, technology protection measures may be disabled for adults or, in the case of minors, minimized only for bona fide research or other lawful purposes. • The use of TikTok, and/or any successor platforms, on all CSUSA, or school -owned devices, or on any device (including privately owned) connected to CSUSA, or school - provided internet is strictly prohibited. FAC Rule 6A-1.0957. 3.4.1 Systems and Network Activities • To the extent practical, steps shall be taken to promote the safety and security of users of the CSUSA online computer network when using electronic mail, chat rooms, instant messaging, and other forms of direct electronic communications. • Specifically, as required by the Children's Internet Protection Act, and Florida Administrative Code ("FAC") Rule 6A-1.0957 prevention of inappropriate network usage includes: (a) unauthorized access, including so-called `hacking,' and other unlawful activities; (b) unauthorized disclosure, use, and dissemination of personal identification information regarding minors; (c) preventing access to websites, web or mobile applications, or software that do not protect against the disclosure, use, or dissemination of students' personal information; and (d) prohibits students from accessing social media platforms, except when expressly directed by a teacher for an educational purpose • Introduction of malicious programs into the network or server (e.g., viruses, worms, Trojan horses, e-mail bombs, etc.). • Revealing your account password to others or allowing the use of your account by others. This includes family and other household members when work is being done at home. • Using a CSUSA computing asset to actively engage in procuring or transmitting material that is in violation of sexual harassment or hostile workplace laws in the user's local jurisdiction. • Duplication of copyrighted software or data, except for backup and archival purposes. • E-mail messages created, sent, or received if they contain intimidating, hostile, or offensive material concerning race, color, religion, sex, age, national origin, disability or any other classification protected by law. • Unauthorized copying of copyrighted material including, but not limited to, digitization and distribution of photographs from magazines, books or other copyrighted sources, copyrighted music, and the installation of any copyrighted software for which CSUSA or the end -user does not have an active license is strictly prohibited • Exporting software, technical information, encryption software or technology, in Internet Acceptable Use and Safety Policy Page 4 of 9 CHARTER SCHOOLS® USA violation of international or regional export control laws, is illegal. The appropriate management should be consulted before the export of any material that is in question. • Effecting security breaches or disruptions of network communication. • Port scanning or security scanning is expressly prohibited unless prior notification to CSUSA's ITSS leadership team has been made. • Circumventing user authentication or security of any host, network, or account. • Interfering with or denying service to any user other than the employee's host (for example, denial of service attack). • Using any program/script/command, or sending messages of any kind, with the intent to interfere with, or disable, a user's terminal session, via any means, locally or via the Internet/Intranet/Extranet. 3.4.2 Education, Supervision and Monitoring • It shall be the responsibility of all members of the CSUSA staff at the school to educate, supervise and monitor appropriate usage of the online computer network and access to the Internet following this policy, the Children's Internet Protection Act, the Neighborhood Children's Internet Protection Act, and the Protecting Children in the 21st Century Act. • Disabling or otherwise modifying any technology protection measures will follow established processes, including documentation and approval by the school's Principal or designated representative. • The School's Principal or designated representative will ensure that age -appropriate training for students who use the School's Internet facilities are provided. The training provided will be designed to promote the commitment to: a) The standards and acceptable use of Internet services as outlined in this policy; b) Student safety in regards to: i. safety on the Internet; ii. appropriate behavior while on online, on social networking Web sites, and in chat rooms; and iii. cyberbullying awareness and response. c) Compliance with the E-rate requirements of the Children's Internet Protection Act ("CIPA"). CIPA Public Hearing Compliance. This Internet Safety Policy was adopted by CSUSA following reasonable public notice and a public hearing or meeting as required by the Children's Internet Protection Act (CIPA), 47 U. S.C. § 254(h). The date of the adoption meeting and the approving authority are documented in the Approvals section of this policy. This policy shall be re -adopted following the same public notice and hearing process whenever material amendments are made, consistent with USAC E- Rate program requirements. • Following receipt of this training, the student will acknowledge that he/she received the training, understood it, and will follow the provisions of the District's acceptable use Internet Acceptable Use and Safety Policy Page 5 of 9 CHARTER SCHOOLS, USA policies. 3.5 Cyberbullyjng and Online Harassment Cyberbullying is strictly prohibited on any CSUSA or school -connected system, device, or network. For the purposes of this policy, cyberbullying is defined consistent with Florida Statute F.S. 1006.147 (the Jeffrey Johnston Stand Up for All Students Act) as bullying through the use of technology or any electronic communication. This includes, but is not limited to, any transfer of signs, signals, writing, images, sounds, or data transmitted by use of any electronic device, including a telephone, computer, cellular telephone, tablet, or any other electronic device. Students or staff who engage in cyberbullying are subject to consequences as outlined in the applicable CSUSA Student Code of Conduct or Employee Handbook. CSUSA may discipline a student or employee for cyberbullying that occurs off campus when such conduct has the effect of substantially interfering with or limiting the victim's ability to participate in or benefit from educational programs. Students, parents, and staff who believe cyberbullying has occurred may report such incidents to the school's Principal or designated representative. Reports may be made anonymously. CSUSA prohibits retaliation against any individual who reports cyberbullying in good faith. The transmission of explicit, sexually suggestive, or nude images via CSUSA systems or devices is strictly prohibited. Consistent with Florida Statute F. S. 847.0141, staff who discover such content involving minors on school systems or devices are required to report the matter to the school's Principal and to law enforcement as required by applicable law. 3.6 Blogging and Social Media • Prior to requiring students to use online content, staff is required to confirm that the content is not blocked by the student internet filter. If staff has appropriate blocked content or social media platforms to be used for educational purposes, then staff must request said content to be reviewed and unblocked. The Blogging and Social Media Policy is designed to protect the privacy, confidentiality, business interests, and reputation of CSUSA. When you are participating in social networking, you are representing both yourself and CSUSA. It is not our intention to restrict your ability to have an online presence. We believe social networking is a very valuable tool. All school administrators, faculty, and staff shall use caution and good judgment when using electronic communications and social networking sites. Any information posted on or communicated through a social networking site shall not bring disfavor, embarrassment, or condemnation to any employee, student, or any member of CSUSA. CSUSA prohibits direct communications relayed to current or former students via electronic communications such as texting, Facebook, and all other social media Internet Acceptable Use and Safety Policy Page 6 of 9 CHARTER SCHOOLS® USA networks. All communications to students should be conducted via the school -issued email addresses or through school -approved applications such as Edmodo. Communications should be professional and related to a student's academic progress or school activities. • The use of TikTok, and/or any successor platforms to be used to communicate or promote any school district, school, school -sponsored club, extracurricular organization, or athletic team is strictly prohibited, per Florida Statute, 1001.02(1), (2)(n), 1003.02(1)(g)5, and 1003.02(1)(g) and FAC Rule 6A-1.0957. 3.7 Blogging and Social Media Policy Guidelines • Employees should not use or post to social media during work hours. • Employees should not use the company or personal devices to access or post on social media networks while at work. • Only employees officially authorized by CSUSA may use approved social media outlets to speak or post on behalf of CSUSA. This will be a part of your CSUSA j ob description. • Employees are restricted from disclosing the details of any CSUSA activity or business dealings on social media. • Do not post any financial, confidential, sensitive, or proprietary information about CSUSA or any of our students, faculty, administrative staff, or employees. • Employees, specifically teachers and administrative staff, are prohibited from using social media to contact or communicate with any current or former students. • Do not use social media to vent personal complaints about supervisors, co-workers, students, parents, vendors, or CSUSA. • If you see unfavorable opinions, negative comments, or criticism about CSUSA, immediately forward this information to your School Administrator or Employee Services. • Information on your networking profile is public, even if posted under a pseudonym, your identity can still be revealed. 4.0 Com lin ance 4.1 Comnliance Measurement The compliance with this policy will be actively monitored through various methods, including but not limited to, business tool reports, internal and external audits, and feedback to the policy owner. CSUSA and all CSUSA managed charter schools will make all reasonable efforts to comply with NIST CSF (Cyber Security Framework) 4.2 Exce to ions Any exception to the policy must be approved by the CSUSA Cybersecurity team in advance. Security breaches: Include, but are not limited to, accessing data of which the employee is not an intended recipient or logging into a server or account that the employee is not expressly authorized to access unless these duties are within the scope of regular duties. Social media: Computer -mediated tools that allow people, companies and other organizations to create, share, or exchange information, career interests, ideas, and pictures/videos in virtual communities. For the purposes of this policy, social media means any platform enabling user - generated content, social interaction, or direct messaging, including but not limited to current and emerging platforms. This definition shall be reviewed and updated annually as part of the regular policy review cycle. Any sites that allow for online collaboration, sharing, or publishing platforms, Internet Acceptable Use and Safety Policy Page 8 of 9 CHARTER SCHOOLS® USA whether accessed through the web, a mobile device, text messaging, email, or any other existing or emerging communications platform. Social media posts: Defined as blog posts, blog comments, status updates, text messages, posts via email, images, audio recordings, video recordings, or any other information made available through any social media outlet. Social media posts are the actual communications a user distributes via social media.
