This approval was valid for twelve (12) months unless extended by a motion of the City Commission at the written request of the applicant. Section 31-73(e)(2) regulates the expiration of conditional use approvals. Applicants may request an extension by submitting a written request within the twelve (12) month period prior to expiration; TFM submitted an extension request on December 9, 2024. The code allows the City Commission, by resolution or motion, to grant an extension of up to six (6) months for good cause shown by the applicant. Once permits have been issued, Conditional Use approvals do not expire. Permitting is well underway. The City Commission can, by Resolution, set parameters for approvals to be extended administratively under specific circumstances. As discussed previously, it has become apparent that The Fresh Market Liquor Store ("TFM") will be unable to begin doing business and serving alcohol within the initial 12 month period contemplated in the Conditional Use (2024-06). As you may know, the construction of the liquor store is tied to the construction of the grocery store, and the construction on the grocery store has stalled as a result of delays in dealing with DERM and WASA, which are preventing TFIVI from completing the project within the originally anticipated timeline. The current estimate for opening of the liquor package store and the grocery store is now at the end of Q4 2025, with the outside chance of a Q1 2026 opening. TFM has started bidding the project to GCs, and it will start construction as soon as they have the required permits. As such, at that time, TFM will be able to better assess the timing of the project. TFIVI would like to request a 6 month extension of time before being required to complete construction and open for business. Signage for ALFs is regulated by Section 31-1910)(2)f of the Land Development Regulations ("LDRs"), which permits up to two (2) wall signs per building. However, the code prohibits wall signs on elevations facing residentially zoned properties located within 300 feet. Directional signage is governed by Section 31-1910)(7) of the LDRs, limiting the maximum area of each sign to four (4) square feet. The applicant, Bercow, Radell, Fernandez, Larkin & Tapanes, on behalf of Belmont Village Aventura Property Owner, LLC, pursuant to Section 31-76 of the code, is requesting the following variances: 1. Accordingly, pursuant to Section 31-76 of the LDRs, the Applicant requests approval of variances from Sections 31-191(j)(2)(f) and 31-191(j)(7)(f) to allow for a wall sign adjacent to residentially zoned property within 300 feet of the elevation and directional signs five (5) square feet in size. Variance Criteria. The proposed variances address the criteria described in Sec. 31-76 governing variances as follows: 1. The particular physical surroundings, shape, topographical condition, or other physical or environmental condition of the specific property involved would result in a particular hardship upon the owner, as distinguished from a mere inconvenience, if the regulations were carried out literally. The unique location and particular condition of the Property creates a hardship upon the owner that is remedied by the granting of these variances. 2. The building will include approximately 67,000 square feet of retail, gym and restaurant spaces, along with 69,000 square feet designated for office use. The first three floors of the building will be dedicated to restaurants, retail and gym, while office spaces will be situated on floors four through nine. The allocation of these various uses on the initial three levels present challenges when interpreting the City's sign regulations. The developer has requested consideration of a multi -tenant sign approval. Section 31-191 (1)(1) of the LDRs provides procedures for review and standards for multi - tenant center sign approvals: The owner of a multi -tenant center, or their authorized representative, may choose to comply with the standards for nonresidential district signs or alternatively, apply for approval as a multi -tenant center as described below. a.
