CITY OF AVENTURA LEGISLATIVE PROGRAM AND PRIORITIES 2025 This document is intended to provide direction to the City Manager, City Attorney, and Legislative Lobbyist regarding the official City position regarding issues and pending legislation that would affect the operation of local government. It further provides priorities for acquiring supplemental funding (grants) for various programs. The City of Aventura will endorse and support legislation that will: 1. Support measures to combat antisemitism in all forms. 2. To improve voting accessibility and increase participation in community association elections, we urge the Florida Legislature to amend Florida Statutes 718.128 and 720.317 to require all condominium and homeowner associations to offer electronic voting by December 31, 2025. Mandating this option would enhance engagement, reduce costs, and improve election transparency while still allowing members to vote by traditional physical ballots if they prefer. The association nW shall provide an option to conduct elections and other unit owner votes through an Internet-based online voting system if a unit owner consents, electronically or in writing, to online voting and if th which includes the following requirements are met: 3. Support the home rule powers of local government. 4. Amend the Live Local Act (SB102) Provisions to grant municipalities more oversight and approval authority regarding density and local infrastructure impact. 5. Amend State Law providing Housing Insurance relief for Florida residents facing staggering insurance premium increases. 6. Provide a dedicated revenue source for Charter School capital improvements at the same levels provided to the local school boards. 7. Support legislation to increase financial support for Charter schools. 8. Increase educational funding levels for Miami-Dade County Traditional and Charter public schools to meet per-pupil State Constitutional requirements. 9. Local Business Tax Receipts (BTR's) — Preserving a municipality's levy ability. 10. Vacation Rental Regulations — Restore authority to local governments to regulate vacation rentals. 11. Preserve municipal authority for red light camera safety and school zone speed camera programs. 12. Support initiatives to address the impact of rising seas on the South Florida area. 13. Support legislation to amend Section 768.28, Florida Statutes, to expressly state that sovereign immunity constitutes immunity from suit (not just immunity from liability) to the extent not waived by applicable law. 14. Support the adoption of legislation to restore municipal authority to regulate drones to protect privacy, persons, and property within the municipality. 15. Support funding to reduce traffic congestion by developing alternate transportation modes. 16. Requesting the Florida Legislature to study the elimination of the automobile no- fault law to enhance safer driving. The decision from the United States Court of Appeals for the Eleventh Circuit (Case No. 23-10656) finds that certain restrictions on public comments imposed by local governments may violate First Amendment rights. RECOMMENDATION It is recommended that the City Commission revisit its current resolution on permissible comments and behaviors to align with both constitutional protections and the need for orderly conduct. While it is essential to uphold every individual's right to express their views, maintaining decorum and respect in the chambers is equally important. The City Commission must balance public participation with the effective functioning of its meetings. In light of this recent court decision, a review of the City's resolution governing comments and behaviors is warranted. Additionally, it is recommended that the City periodically reassess these regulations to ensure ongoing compliance with legal standards and to address the evolving needs of our community. Attachment CITY OF AVENTURA RESOLUTION NO. 2024-38 A RESOLUTION OF THE CITY COMMISSION THE CITY OF AVENTURA, FLORIDA, AMENDING THE RULES OF DECORUM SET FORTH IN RESOLUTION 223-30 BY FURTHER ELABORATING ON THE MEANING OF DISRUPTIVE CONDUCT DURING PUBLIC MEETINGS; PROVIDING FOR CONFLICTS; PROVIDING FOR VBILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 4.01 of the City Charter of the City of Aventura, Florida, provides that the City Commission may establish procedures relative to City Commission meetings and agendas; and WHEREAS, Resolution 96-18 set forth the general authority for the Mayor to maintain decorum at Commission meetings but cites no specific rules or policies for the Mayor to rely on when a speaker or member of the audience acts in a manner prejudicial to the proper conduct of a City Commission meeting; and WHEREAS, the City Commission adopted Resolution 2023-30 to establish rules of decorum and also require speakers to refrain from disruptive conduct when addressing the City Commission at a public meeting; and WHEREAS, the term "disruptive conduct" is not defined in Resolution 2023-30 other than referencing impertinent or slanderous comments; and WHEREAS, the City Commission wishes to amend the Rules of Decorum by offering further guidance to the public by providing additional examples of prohibited disruptive conduct, potentially resulting in a person relinquishing the right to continue to speak at a meeting; and WHEREAS, the approval of this Resolution is in the best interest and welfare of the residents of the City of Aventura. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF AVENTURA, FLORIDA, AS FOLLOWS THAT: Section 1. Resolution 2023-30 is hereby amended to further define the term "disruptive conduct." Section 2. Section 3 "Decorum Speaker" is hereby amended to read as follows: That any person making impertinent or slanderous remarks or who becomes boisterous while the addressing the Commission shall relinquish the right to continue to speak. If, after sufficient warning by the Mayor, the speaker fails to cease the disruptive conduct, City of Aventura Resolution No. 2024-38 including, but not limited to, making comments characterized as hate speech, fighting words, or defamation of character, the individual shall be removed from the meeting by the Aventura Police Department, at the direction of the Mayor, for the remainder of the meeting. Section 3. Conflict. All Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict, Section 4. Severability. If any clause, section, or other part of the application of this Resolution shall be held by any Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part or application shall be considered as eliminated and so as not affecting the validity of the remaining portions or applications of this Resolution, Section 5. Effective Date. This Resolution shall take effect immediately upon its passage and adoption. The foregoing Resolution was offered by Commissioner Kruss, who moved its adoption.
