2023 Legislative Update (prepared 4/14/23)
Form 6 (SB 774/HB 37)— Requires local elected official to file Form 6 instead of Form 1. Will take effect
January 1, 2024. Form 6 requires individual to disclose net worth and list all assets and liabilities over
$1,000. Passed by Senate, in House committee (last action 4/12)
Affordable housing (SB 102)— Establishes uniform standards and criteria for local governments to follow
when approving projects with affordable housing component. Signed by Governor(takes effect 71/23)
Business impact estimate (SB 170/1-113 1515) — Local governments must produce a business impact
estimate prior to passing an ordinance, and must be published on the government's website. Imposes
conditions on lawsuits brought by any party to challenge the validity of local ordinances. Provides that a
properly noticed consideration of a proposed ordinance may be continued to a subsequent meeting under
certain circumstances, without further publication, mailing or posted notice. Passed by Senate, in House
(last action 3/9)
Resiliency and Safe Structures Act (HB 1317/SB 1346) — Limits local government's ability to prohibit,
restrict or prevent the demolition of nonconforming structures, limits local government's authority to
limit the approval of the replacement structure. In House and Senate committees (last action 4/13)
Condominiums and cooperative associations(SB 154/1-1B 1395)—Further revises the milestone inspection
requirements, requires Florida Building Commission to establish a building safety program to implement
milestone inspection requirement by 12/31/24. Revises the reserve funding requirements relating to
condominium and cooperative associations. Passed by Senate, in House committee (last action 4/13)
Short-term vacation rental registration program (HB 833)—Allows local governments to adopt vacation
rental registration program, standardizes the registration fee, limits information that can be collected
from vacation rental owner, rules specifically adopted for vacation rental (noise, occupancy) are not
allowed. In House committee (last action 4/12)

County League of Cities (MDCLC) for the Period of One Year (City
Manager)
April 20, 2023 City Commission Workshop Agenda
The Miami-Dade County League of Cities (MDLC) has requested each member
municipality to designate one of its elected officials to serve as Director and one as
Alternate Director to the League for a period of one year. The term commences on the
date of the Annual Meeting in the month of May and runs until the following May.
I have placed this matter on the Workshop Agenda for discussion.

Rules of conduct at public meetings
Intent:The City Commission recognizes the importance of protecting the rights of all speakers to express
opinions on the operation of city government and encourage participation at Commission meetings. The
Commission shall not prohibit public criticism of the policies, procedures, programs or services of the
Commission or the City. Speakers' comments that go beyond the role and authority of the Commission
give no privilege or protection. The Commission recognizes all rights granted to speakers under the law,
but also has the right to conduct orderly and efficient meetings in order to complete City business in a
timely manner.
General requirements: The Mayor shall rule out of order any member of the public who shall speak
without being recognized and must address the Commission from the podium or other established
speaking area. Comments shall be directed to the Commission as a body and not to individual Commission
members. The speaker must observe the time limits set for public comments
Decorum: Any person making impertinent or slanderous remarks or who become boisterous while
addressing the Commission shall relinquish his/her right to continue to address the Commission. If, after
sufficient warning by the Mayor, the individual fails to cease the disruptive conduct, the individual shall
be removed from the meeting by the Aventura Police Department, as directed by the Mayor. Once
removed, the individual shall be barred from further audience for the remainder of the meeting. No
clapping, applauding, heckling or verbal outbursts in support or opposition to a speaker or his or her
remarks shall be permitted.
Signs, placards, banners. For public safety purposes, no signs or placards mounted on sticks, posts, poles
or similar structures shall be allowed in Commission Chambers or meeting rooms. Other signs, placards
or banners shall not disrupt meetings or interfere with the view of other in attendance at the meeting.
The Mayor, as presiding officer, is granted the authority to disallow all signs, placards and banners.

expire in May:

Due to vacancies on the Board as a result of the resignation of three Board Members, the
following individuals were appointed in March 2023 as replacements to serve out the
remainder of the vacated terms ending in May, when the Members will be eligible for
reappointment:

I am recommending the following members to be appointed/re-appointed to the
Community Services Advisory Board:
