Klopp, Community Development Director DATE: January 13, 2023 SUBJECT: Proposed Color Palette January 19, 2022 City Commission Workshop Agenda Item BACKGROUND The City Commission requested, at a previous Workshop, that staff present a recommendation for the adoption of a color palette for buildings in the City. At the December 2022 Workshop, the Commission indicated a comfort level with the process recommended, but requested that a broader palette be considered. RECOMMENDATION Having reviewed other cities' codes, it is recommended that Aventura model its requirement after Homestead's ordinance, utilizing Miami Beach's palette. ANALYSIS Miami Beach's palette represents most of the various hues - including blue, green, and yellow - and contains over 200 preselected colors, all of which are moderate in intensity. Review of Homestead's process: Homestead's Chapter 32, Article 11 includes a color palette adopted by the City Commission. The permit requirement applies to multi-family, townhouse or nonresidential buildings. Appeals are to the City Commission. The standard for the Commission to allow colors that don't qualify for an exemption is to determine that the color is harmonious based upon "the color palette as it has been applied to structures that comply with the requirements of the color palette within a three hundred-foot radius." The color requirement is part of the commercial painting permit requirement — adding color as part of the permit review process. A few minor edits from Homestead's model would be needed to make it applicable to Aventura. Additional research As an alternative to the recommendation provided, another option could be for staff to conduct further research toward finding or creating a color palette fulfilling Aventura's vision. CONCLUSION Staff recommends Miami Beach's palette (see attached) using Homestead's process. The rules would apply to multi-family, townhouse and nonresidential buildings. Appeals would be to the City Commission. Klopp, Community Development Director DATE: January 13, 2023 SUBJECT: Ordinance Amending Article I of Chapter 14 of the City Code by Creating Code Section 14-3 Annual Certification of Structural Maintenance (City Manager) January 19, 2023 City Commission Workshop Agenda Item RECOMMENDATION It is recommended that the City Commission: 1) Amend Chapter 14— Buildings and Building Regulations, Article I. — In General, by Creating Code Section 14-3. —Annual Certification of Structural Maintenance BACKGROUND This item was discussed at the December 2022 City Commission workshop. The description of how the certifications will be handled by the City has been revised based upon input from the City Commission. A report by the Miami-Dade County Grand Jury aimed at building safety recommended that Building Officials remind owners to maintain their buildings "in a safe condition." Thus, staff created and suggests implementation of Section 14-3(see below)which would require the responsible party to submit an annual certification of structural maintenance, which report shall be filed with the City on or before December 15 each year. The Department's recommendation is that a form be provided for the responsible party to submit. The form would list the following: roof, structure, fireproofing and fire protection systems, elevators, heating and cooling systems, plumbing, electrical systems, swimming pool or spa and associated equipment, seawalls, pavement and parking areas, drainage systems, painting and waterproofing, irrigation systems, and termite protection. (see attached) This checklist of the elements to be included in the annual certification would be provided by the City. The City will verify the annual submittal of the certifications, review the submittals, and follow-up on any repairs or replacements determined necessary thereby, if any. The certifications would be kept on file for future reference by the building's residents, officers and managers. The following code revision would implement this recommendation: Section 14-3. —Annual Certification of Structural Maintenance (a) The duties imposed by this Section are applicable to any person (the "Responsible Person") who serves as the president (the "President') of a condominium association, homeowners association or cooperative owners association (each constituting a "Community Association" for the purposes of this section). The duties of this Section shall also apply to any person, firm, corporation or entity serving as a property manager (the "Property Manager") for a Community Association or as a property manager for any apartment complex of more than four (4) units. (b) The annual certification of structural maintenance described above, shall be filed annually with the City officials listed above on or before December 15 by the Responsible Person. Filing shall be accomplished by hand delivery to the offices of the City's Chief Building Official and City Manager at the Aventura Government Center and/or by email filing at the following link: engineeringreports@cityofaventura.com or other link provided for this purpose on the City's website. (c) If an annual certification of structural maintenance report is hand delivered, it shall be hand delivered to the offices of the City's chief Building Official and City Manager in both digital format and hard copy for compliance with this Section. (d) A Community Association shall be responsible for the payment of any fine which would otherwise be payable by the President of the Community Association for a violation of this Section. (e) The Director of the Community Development shall prepare a guidance to which responsible parties should refer as they prepare their annual certifications. The Director shall annually review the guidance, update it as necessary, and distribute it to the Community Associations and Managers. Repeal of Chapter 30, Article V Chapter 30, Article V (Section 30-180) of the City's Code requires every building to have a termite inspection conducted and submitted to the City every year. Proposed Development. Attached for your review is the proposed Aventura Food Hall site plan progress set. The intent is to create a venue accessible by local residents, visitors, hotel guests, pedestrians, and share riding facilities. As reflected on the draft plan set, the development follows more urban design, proposing a more modest three-story development, featuring a rooftop and entertainment restaurant atop of the parking garage as well as ground level restaurants and retail space. The proposed development features a drop-off area on the south side to accommodate ride sharing services such as Lyft or Uber, as well as a drop-off area to accommodate Freebee riders. The upper roof area will feature a large green area and the ground floor is intended to activate the street with reduced setbacks to take advantage of the proximity to the drop-off area in the event of inclement weather. The proposed uses permitted under Section 31-144c(1)(w), although a special exception may be needed because of the proximity of the use to religious facilities or other alcohol service establishments. The proposed use will serve as a benefit to the overall surrounding community, by providing alternate sources of entertainment and dining in this location. The Property is in close proximity to Williams Island and numerous other nearby venues which support access to the Property to be easily accessed without the need for every visitor to drive to the site. Additionally, based on the venues it is anticipated a high percentage with utilize ride sharing services. C. Anticipated Requests As part of the development, we anticipate seeking a relaxation of the setbacks in relation to the drop off area along NE 185th Street where it may make sense to pull the covered area of the structure closer to the vehicle drop off area, as well as relief related to driveway separation. Additionally, as illustrated on the attached, the ground floor will consist of a high ceiling open air development with internal landscaping, but with protection from the elements to create a more useable space. The covered area, while serving an important function, does count toward lot coverage. Therefore, we anticipate seeking relief from the lot coverage requirements to allow open air covered seating and circulation. Researchers from the University of Colorado and the National Renewable Energy Laboratory conducted a study to document the impact of ride sharing on parking (see Attachment A). The results suggest that: i) ride-hailing is replacing driving trips and could reduce parking demand, particularly at land uses such as airports, event venues,restaurants, and bars; ii)parking stress is a key reason respondents chose not to drive; and iii)respondents are generally willing to pay more for reduced parking time and distance. The study estimates that about a quarter (25%) of all ride hailing trips would have otherwise consumed a parking space. This is especially true for destinations where it is hard or expensive to park, including airports, concert venues,universities, downtowns,bars and restaurants. Pedestrian/Bicyclist The project is located in an area conducive to pedestrian and bicycle activities. The area surrounding the proposed project has a comprehensive sidewalk network, signalized intersections with clearly marked crosswalks, and pedestrian signals. This environment promotes walking and bicycling as a means of transportation and further reduces the need for off-street parking. Transit Availability Miami-Dade Transit-the immediate area near the project is served by Miami-Dade bus routes 3, 93 and 183. The closest bus stops to the project are located on the east side of Biscayne Boulevard at NE 187 h Street and at NE 1861' Street. Aventura Express Shuttle Bus — the project area is served by the Yellow route. This route has direct access to the Walgreens directly adjacent to the project. Aventura Freebee — the project is located within the freebee service area. The Freebee is a free door-to-door, on-demand transportation service provided by the City. The use of transit is another effective way to reduce the need for off-street parking. Based on the table provided above,parking requirements can be reduced by 10%given the availability of transit services in the area. The required number of parking can be further reduced by 10%based on the availability of transit and 5%based on the existing pedestrian and bicycle infrastructure of the area. This will represent a reduction of approximately 47 parking spaces for a total of 87 spaces required. Therefore, it is our professional opinion that the 115 parking spaces provided by the project which represents a 15%parking reduction, should satisfy their parking demand. Signage: The hotel has a serious visibility problem. Sitting at an angle, the main (larger) sides of the building face northeast (towards Lehman causeway), and southwest (towards NE 191 St.). There are currently 2 signs at the top of the building, on the northwest (short side) and southwest (long side facing NE 191 St.). That means there's no identification on the northeast side, facing the Lehman Causeway, and as a result we've gotten complaints that it's not always easy to End the hotel. Even if they are following GPS they lack the frame of reference you get when you see the sign, letting them know which building they are going to. It is also important, not only to bring national and international visitors to the city of Aventura, but to bring in the regional traffic as well. Anyone coming to the city for other business, or to visit other restaurants or the mall, as they travel at high speeds ❑n the Lehman Causeway, will not even be aware that there's a Hilton Full Service there. Those folks could come t❑ the city for one thing, notice the hotel, and decide they should stay there next month so we're close to the golf courselshoppinglentertainmentlete. But they need to be able to identify the hotel first. This also hurts the spur of the moment decision to stop and eat at our restaurant. We cannot eliminate one of the existing signs in order to add the third because the building requires all 3 signs due to it's unusual orientation at an angle, and the fact that it's hidden behind other buildings. The hotel is squeezed in between the causeway to the north, an office building to the south, and the Courtyard Marriott to the west. The hotel requires signs on all three sides in order to cover the different angles from mayor roadways. Exterior Accent Lighting. Along with helping with the visibility problem, our exterior accent lighting helps emphasize the architectural features of the building. The accent lighting will bring interest to the building without overemphasizing the building, and overpowering its environment. The innovative optical system produces pleasing graphic effects. WHEREAS, the City of Aventura, in conjunction with Miami-Dade County, has the authority to name streets within the City's jurisdiction for use as a specific reference point for a geographic area in the City and/or to reflect the character of the neighborhood; and WHEREAS, the Hidden Bay residential community ("Hidden Bay") is the cornerstone community located on the end of the street currently known as Marina Del Ray Boulevard/NE 190t" Street, located east of Country Club Drive to the entrance of Hidden Bay; and WHEREAS, the residents of the Hidden Bay community support the co- designation of this street to Hidden Bay Drive; and WHEREAS, the City Commission finds that this Resolution is in the best interest of the City and its residents to co-designate this street as Hidden Bay Drive. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF AVENTURA, FLORIDA: Section 1. Recitals Adopted. That the above stated recitals are hereby adopted and confirmed. Section 2. Hidden Bay Drive Co-Designation. That the City Commission hereby co-designates the street east of Country Club Drive to the entrance of the Hidden Bay residential community by removing the name "Marina Del Ray Boulevard" and renaming it "Hidden Bay Drive", and shall as soon as authorized by Miami-Dade County, be known in and by the City of Aventura as NE 190t" Street and "Hidden Bay Drive." Upon County approval, signs shall be made and installed above the present place declaring such designation. Section 3. Implementation. That the City Clerk is hereby directed to submit this Resolution to Miami-Dade County and other appropriate agencies, and along with the City Manager, take all action necessary to implement this Resolution. City of Aventura Resolution No. 2023- Section 4. Effective Date. That this Resolution shall become effective immediately upon its adoption.
