RESOLUTION NO. 2014-25
A RESOLUTION OF THE CITY COMM SSION OF THE
CITY OF AVENTURA, FLORIDA AUTHO IZING THE CITY
MANAGER TO EXECUTE AND OTHERW SE ENTER INTO
THAT CERTAIN INTERGOVERNME TAL AGENCY
AGREEMENT, ATTACHED HERETO, B AND BETWEEN
THE CITY OF AVENTURA AND MIAMI-D DE COUNTY, A
POLITICAL SUBDIVISION OF THE STA E OF FLORIDA,
TO PERFORM TRAFFIC ENGINEERI G FUNCTIONS
SPECIFICALLY RELATING TO THE IN TALLATION OF
PEDESTRIAN CROSSING SIGNS ON OUNTRY CLUB
DRIVE; AUTHORIZING THE CITY MANA ER TO DO ALL
THINGS NECESSARY TO CARRY OU THE AIMS OF
THIS RESOLUTION; AND PROVIDING AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT RESOLVED BY TH, CITY COMMISSION OF THE
CITY OF AVENTURA, FLORIDA, THAT:
Section 1. The City Manager is authorized to e ecute and otherwise enter into
that certain Intergovernmental Agency agreement, attac ed hereto, by and between the
City of Aventura and Miami-Dade County, a political su division of the State of Florida,
to perform traffic engineering functions specifically elating to the installation of
pedestrian crossing signs on Country Club Drive.
Section 2. The City Manager is hereby authori ed to do all things necessary
and expedient in order to effectuate the execution o the Agreement described in
Section 1 above and to carry out the aims of this Resolut on.
Section 3. This Resolution shall become e ective immediately upon its
adoption.
The foregoing resolution was offered by Vice Mayor Joel, who moved its
adoption. The motion was seconded by Commissioner Stern, and upon being put to a
vote, the vote was as follows:

INTERGOVERMENTAL AGENCY A REEMENT
TO PERFORM TRAFFIC ENGINEERIN FUNCTIONS
THIS INTERGOVERNMENTAL AGENCY AGREE ENT TO PERFORM TRAFFIC
ENGINEERING FUNCTIONS (AGREEMENT), made and entered into this day of
, 2014, by and between the CITY OF A ENTURA, FLORIDA, a municipal
corporation of the STATE OF FLORIDA, hereinafter referred o as the CITY, and MIAMI-DADE
COUNTY(COUNTY), a political subdivision of the STATE OF FLORIDA, MIAMI-DADE County.
WITNESSETH
WHEREAS, pursuant to Section 2-96.1 of the Miami-D de County Code, all traffic control
and traffic engineering services in Miami-Dade County are un er the exclusive jurisdiction of the
COUNTY; and
WHEREAS,the CITY desires to assume the installation and maintenance responsibilities of
certain traffic engineering functions pertaining to its local muni ipal streets only; and
WHEREAS, the COUNTY has determined that the C TY is both equipped and able to
perform the traffic engineering functions as herein specified o its local streets; and
WHEREAS the CITY has, by proper resolution attaches hereto and by reference made a
part hereof, authorized its officer(s) to enter into this AGREEM NT.
NOW THEREFORE, the CITY and the COUNTY agre= as follows:
1. The recitals set forth above are incorporated he ein by reference.
2. The CITY will only install and maintain the followi g designated types of traffic control
devices and only on those local municipal streets operated an. maintained by the CITY within its
boundaries:

• Coronado Crossing near 20441 NE 30th Ave ue
• El Dorado Crossing near 3625 North Count Club Drive
• The Landmark Crossing near 21091 East Co ntry Club Drive
• The Yacht Club at Aventura Crossing near 1:655 East Country Club Drive
Traffic calming devices may be installed on local municipal str=ets only after an appropriate traffic
engineering study has been performed and sealed and signe• plans have been submitted to the
Public Works and Waste Management Department of the CO NTY for its review and approval.
3. The CITY shall attach a decal to the back of the s gn panels indicating ownership and
date of installation.
4. The CITY assumes sole and complete responsi ility for the maintenance of all such
signs that are installed by the CITY within its boundaries.
5. The CITY assumes sole and complete liability fo any accidents and/or injuries which
may or are alleged to occur or arise out of the installation, ope tion or maintenance of said traffic
control devices, and hereby indemnifies and saves harmless th- COUNTY from any and all claims
of negligence as a result of the installation, operation or maint:nance of said signs.
6. All traffic control signs installed by the CITY in -ccordance with this AGREEMENT
shall conform to the applicable requirements established by th- following publications:
Florida Department of Transportation's Standa d Specifications for Road and
Bridge Construction.
Manual on Uniform Traffic Control Devices fo Streets and Highways, U.S.
Department of Transportation Federal Highw- Administration (ANSI D6.1e-
1989), including latest revisions.

7. For installation of traffic control devices,the CI shall hire a COUNTY licensed
contractor or perform the work in-house by the CITY Public W.rks crew.
8. Should the CITY install street name signs at t e same site where a stop-top
street name exists, then the CITY shall utilize the other corners of the intersection.
Subsequently, the CITY, shall remove the COUNTY'S stop- op street name signs by an
approved sign contractor.All signs and hardware removed shall be dismantled and returned to
the Traffic Signals and Signs Division of the COUNTY'S Public orks and Waste Management
Department.
9. The CITY shall be responsible for keeping reco ds of any and all installations
and repairs, and furnishing pertinent documents as and when s:id records may be requested.
10. Failure to carry out any of the duties and respo sibilities assumed herein by
the CITY may result in termination of this AGREEMENT,at the -ole discretion of the COUNTY.
