RESOLUTION NO. 2005.32
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF AVENTURA, FLORIDA DEDICATING A TEN (10)
FOOT WIDE EASEMENT TO FLORIDA POWER AND
LIGHT ON THE MIDDLE SCHOOL WING ADDITION;
PROVIDING FOR RECORDATION; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Aventura requires electrical service to the new Middle
School Wing Addition located at 3333 NE 188th Street; and
WHEREAS, Florida Power and Light requires a recorded easement prior to
providing electrical service to the new addition; and
WHEREAS, Florida Power and Light requires a recorded easement to operate
and maintain said electrical services; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF AVENTURA, FLORIDA, THAT:
Section 1.
That the Easement dedication, as reflected on the attached
Easement, inclusive of the Sketch and Legal Description, is hereby approved and the
City Manager is hereby authorized to cause such Easement to be recorded in the
Official Records of Miami-Dade County, Florida, subject to confirmation by the City
Attorney as to the legal form and sufficiency of the Dedication and instrument of
conveyance.
Section 2.
The City Manager is authorized to take all action necessary to
implement the purposes of this Resolution.

Section 3.
This Resolution shall become effective immediately upon its
adoption.

valuable consideration, the adequacy and receipt of which is hereby acknowledged,
grant and give to Florida Power & Light Company, its licensees, agents, successors,
and assigns, an easement forever for t11e construction, operation and maintenance of
overhead and underground electric utility íàcilities (including wires, poles, guys,
cables, conduits and appurtenant equipment) to be installed ftom time to time; with
the right to reconstruct, improve, add to, enlarge, cbange the voltage, as well as, the

within the easement and to operate the same for communications purposes; the right of ingress and egress to said preIDlses at all times; the
right to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the easement area; to trim and' cut and keep
tnmmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the easement area which might interfere with or fall upon the
lines or systems of communications or power transmission or distribution; and further grants, to the fullest extent the undersigned has the
power to grant, if at all, the rights hereinabove granted on the land heretofore descnoed, over, along, under and across the roads, streets or
highways adjoining or through said property.
