SUBJECT: Proposal to permit Adult Retirement Communities associated with
Country Club/Resort Hotels

I. THE REQUEST
The owner of the Fairmont Turnberry Isle Resort has requested an amendment to the
Business & Office future land use designation in the City's Comprehensive Plan, an
amendment to the definitions in the Land Development Regulations and an amendment
to the Community Business (B2) zoning district to permit adult retirement communities
associated with to country club/resort hotels.
The property is designated as Business & Office future land use category in the City's
Comprehensive Plan and is zoned B2, Community Business District in the City's Zoning
Map. An aerial photograph showing location of the property is attached.
The owner is proposing an adult retirement community (ALC) as an expansion of the
amenities of the country club/resort hotel, to be located on the existing
nursery/maintenance site on West Country Club Drive. The proposal is that each unit
in the ALC would have a membership in the country club and that the ALC site would
be joined by covenant with the existing country club/resort hotel so that one parcel may
not be sold without the other. The owner advises that retirees in the City of Aventura
and the City of Palm Beach are the target market. The existing nursery and hotel
maintenance operations are proposed to be housed on the first floor of the new
structure. The intent is independent living units with some on-site assisted care units,
so that retirees can evolve from independent living to assisted care within the same
building. The use differs from an assisted living facility in that it is designed primarily for
independent living with limited care and is unique in that it relies on the existing country
club/resort hotel to provide its amenities.
The proposed text changes to the Comprehensive Plan and Land Development
Regulations are shown in underlined text to indicate additions, as follows:
I. Comprehensive Plan Text Amendment
"FUTURE LAND USE ELEMENT
LAND USE GOAL
Provide the best possible distribution of land use and services to meet the
physical, social, cultural and economic needs of the present and future
populations of the City.
Policy 2.2
The Future Land Use map shall identify all nonresidential land as one of the following
nonresidential land use categories:
"Business and Office
This category accommodates the full range of sales and service activities. Included are
retail, wholesale, personal and professional services, commercial and professional
offices, hotels, motels, hospitals, medical buildings, nursing homes, adult retirement
communities associated with country club/resort hotels. entertainment and cultural
facilities, amusements and commercial recreation establishments. However, private
commercial marinas may only be permitted as a conditional use as contained within the
land development regulations. These uses may occur in self-contained centers, high-
rise structures, campus parks, Town Centers or in nodes defined by the intersection of
two arterial roadways or the intersection of an arterial and a local or collector street.
Additionally, the Metropolitan Urban Center (MUC) designation as described and
adopted within the Miami-Dade Comprehensive Master Development Plan may be
applied as an overlay within this land use category.
The specific range and intensity of uses appropriate in a particular Business and Office
property is dependent on the particular land use, design, urban services, transportation,
environmental and social conditions on and around the subject parcel at the time of
approval including consideration of applicable goals, objectives and policies, and the
provisions of applicable land development regulations which serve to implement the
comprehensive plan.
The maximum allowable development intensity shall be a floor area ratio of total
building square footage (not including parking structures) divided by the net lot area of

the development parcel of 2.0. Actual intensities approvable to a given site may be
significantly lower than the maximum where necessary to conform to an overriding Plan
policy, or to maintain compatibility of the development with its surroundings. The
maximum intensity allowable on a given site shall also be contingent on the ability of the
developer to ensure appropriate transitions and buffers with the surrounding
neighborhood, and to alleviate impacts that will adversely impact service levels and
quality of life."
II. Land Development Regulations Amendment
Proposed Addition to Section 31-21, Definitions
"Sec. 31-21. Definitions
For the purposes of this chapter, the following words, terms and phrases shall have the
meaning herein set out. When these definitions include restrictions, conditions or
limitations, such restrictions, conditions or limitations shall be subject to enforcement
upon the same basis as other provisions of these Land Development Regulations.
Adult Retirement Community is an independent livinQ facilitv caterinQ to individuals that
have retired from active workinQ life bv providinq on-site dininQ facilities. limited assisted
care. on-site recreational activities or other amenities. An adult retirement community
may have an assisted Iivinq facilitv component and shall be restricted to individuals aQe
55 or older.
Country Club/Resort Hotel is a resort hotel and private recreational club that shall
include or be adiacent to a qolf course and includes hotel amenities and club facilities
primarilv available to hotel Quests. club members and their Quests; and may contain an
Adult Retirement Community. The hotel amenities may include a spa. meetinq rooms,
restaurants. concierQe services and other incidental uses. The club facilities may
include a club house, pro shop. locker rooms. swimminQ pools. cabanas. alcoholic
beveraQe sales. dininq room facilities. tennis courts, puttinQ Qreens. Qolf drivinq ranQes
and other incidental uses.
Proposed Addition to Community Business (B2) District, Section 31-144(c)
Sec. 31-144. Business Zoning Districts.
(a) Purpose. These business districts are intended to provide for commercial
development in conformance with the Comprehensive Plan and provide for a variety of
zoning districts to accommodate the City's business and commerce needs. These
zoning districts may be applied to land designated Business and Office and Industrial
and Office on the City's Future Land Use Map, however, the uses within this district
shall be consistent with, but may be more restrictive than, the corresponding Business
and Office and Industrial and Office category permitted uses.

Development and/or redevelopment of a parcel in the Business Zoning Districts shall be
subject to the site development standards set out in the zoning districts of this section.
The floor area ratio permitted in Business Zoning Districts shall not exceed the
maximum of 2.0 as set out in the Business and Office Future Land Use Category in the
City's Comprehensive Plan.
(c) Community Business (B2) District. This district is intended primarily to provide for
general commercial activity for a wide range of goods and services to the entire
community and sub region. Such businesses generally require locations convenient for
both vehicular and pedestrian traffic and would be expected to have orientation toward
and direct access to arterial roadways.
(1) Uses permitted. No building or structure, or part thereof, shall be erected, altered
or used, or land used in whole or part for other than one or more of the following
specific uses provided the requirements set forth elsewhere in this section are
satisfied:
a. Any use permitted in a B1 District subject to the requirements of that district as
outlined herein.
b. Auditoriums.
c. Automobile new parts and equipment, sales only.
d. Bait and tackle shops.
ff. Country club/resort hotels.
9.9." Accessory uses and structures.
(5) Site Development Standards.
b. Maximum height: 12 stories or 120 feet overall maximum height, including
structure parking. That portion of the building or structure within 200 feet of any
residential zone shall be subject to a height limitation of one foot for every two
feet in distance from the residential zoned plot, unless the application of this
requirement would limit the building height to a minimum of 25 feet. This
provision shall not applv to Adult Retirement Communities in the B2 zoninQ
district.
Analvsis of the Request
The request is a policy decision as to whether this type of use is appropriate in the
Business & Office future land use category and in the B2 Community Business zoning
district. The City Attorney's office has reviewed the proposal and found no legal
impediment to the requested changes. The amendments would require an application

for amendment to the text of the Comprehensive Plan and for amendment to the text of
the Land Development Regulations. Each of those applications would be processed
using the criteria for amendment in Sections 31-53 and 31-77 of the Land Development
Regulations. The text amendment to the Comprehensive Plan would also require
transmittal for compliance determination by the Florida State Department of Community
Affairs.
The Business & Office future land use category currently contemplates nursing homes
as a permitted use in the category, as it is regarded as a business operation rather than
a residential use even though people reside in the facility as full-time "residents". The
owner opines that this proposed adult retirement community is also a business, being a
rental unit building and an amenity to the country club/resort hotel, and properly fits
within this future land use category. The owner's argument is similar for inclusion of the
adult retirement community use in the B2 zoning district through its requested
amendment to specifically permit the use within country club/resort hotels within this
district; that is, the use is an amenity to the existing country club/resort hotel business
and relies upon the country club for its recreational and leisure activities.
The height restriction in the B2 site development standards provided in Section 31-
144(c)(5)(b) of the Land Development Regulations is in place to protect residential uses
from adjacent business uses. The owner is requesting that adult retirement community
buildings be exempted from this height restriction due to the unique and low-intensity
nature of the use.

City Clerk Evaluation
On August 12, 2010, Teresa will celebrate her fourteenth year as our City Clerk. I know
that we all agree that we are fortunate to have her in that position. She has once again
performed exceptionally well this past year.
In addition to her service to the City, Teresa continues her dedication to her profession
by her active participation in the local, state and international municipal clerk
organizations and is well-respected among her colleagues. This is not only evidence of
her knowledge and expertise of her duties and responsibilities, but is also a positive
reflection on our City of Excellence.
Based on the foregoing, I recommend a $10,000 net bonus be given to her (the same
as last year), COLA increase as will be given to all employees in October and no other
increase in salary or benefits.
