The following is a breakdown of the performance for the red light cameras for Sept 2008:
For the month we reviewed 2,011 violations, and accepted 1,824 as an infraction, We rejected 187 incidents, The
approval rate is approximately 90,7%. A total of 5 vehicles were "city" or other government vehicles and approved as
violations, We also have 489 violations still at the vendor, undergoing their verification and entry process before they are
sent to us,

3 A RESOLUTION OF THE CITY OF HALLANDALE '
4 BEACH, FLORIDA, SUPPORTING AN INCREASE IN
5 FLORIDA'S CIGARETTE TAX
6
7 WHEREAS, tobacco use kills more than 400,000 people each year in the
8 United States, more than the total number killed by AIDS, alcohol, motor vehicles,
9 homicide, illegal drugs, and suicide combined, and;
10
11 WHEREAS, cigarette smoking accounts for at least 30% of all cancers
12 deaths, 87% of lung cancer deaths, and is associated with increased risk of at least
13 15 types of cancer, and;
14
15 WHEREAS, smoking is a major cause of heart disease, cerebrovascular
16 disease, chronic bronchitis, and emphysema, and is associated with gastric ulcers,
17 and;'
18
19 WHEREAS, secondhand smoke contains more than 4,000 substances, more
20 than 50 which are known or suspected to cause cancer, and;
21
22 WHEREAS, in Florida, nearly 1.2 million youth alive today will become
23 smoke'rs and approximately 369,000 will die from smoking, and;
24
25 WHEREAS, smoking caused health costs in Florida total more than $6.3
26 billion annually, with $1.2 billion being covered by the state's Medicaid program, and;
27
28 WHEREAS, Florida has not increased its cigarette tax since July 1990,
29 ranking 46th lowest in the nation with 33.9 cents per pack, while national average is
30 $1.18 per pack, and;
31
32 WHEREAS, increasing Florida's cigarette tax by $1.00 per pack would likely
33 generate more than $1.06 billion of tax revenue, while preventing 224,600 kids from
34 starting to smoke and causing 123,300 adults to stop smoking;
35
36 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
37 THE CITY OF HALLANDALE BEACH, FLORIDA:

39 SECTION 1. The City of Hallandale Beach Supports measures that would
40 increase Florida's cigarette tax by at least $1.00 per pack, as this tax will generate
41 badly needed funds for healthcare, and will also help people quit smoking and
42 discourage youths from starting to smoke. This increase will put Florida once again
43 back in the forefront of the tobacco control movement, achieving the Gold Standard
44 in tobacco control.

Increase cigarette tax, save lives

I strongly support the Orlando Sentinel's position that raising the state's cigarette excise tax offers a
responsible solution to aid Florida's budget struggle ("Lawmakers are taking the easy way out when
balancing the budget," Aug. 21). Rather than cutting funds, this action will provide state leaders with a
means to create much-needed revenue.
Florida sold nearly 1.3 billion packs of cigarettes in 2006 alone. A $1 increase in the state's cigarette tax
would generate about $1.1 billion in new net revenue. Prevention in this increase would also save more
than 209,000 kids from becoming smokers, help 123,600 current adult smokers quit and save 32,700
lives from smoking-caused deaths. Financially, this translates to $4.8 billion in long-term health
savmgs.
This is an important measure that would save Floridians' lives. Cigarette smoking remains the leader in
preventable causes of death in the United States, taking the lives of more than 28,000 Floridians each
year. In our state, total annual health costs related to smoking equal $6.32 billion, with an additional
$6.47 billion in lost productivity.
Rather than furthering the state's budget gap or creating more devastating cuts, increasing the state's
cigarette tax by $1 would provide much-needed relief to our struggling economy and protect millions of
Floridians from the dangers of tobacco.

AN ORDINANCE OF THE CITY OF A VENTURA, FLORIDA;
AMENDING CHAPTER 30 "ENVIRONMENT", BY CREATING
ARTICLE VIII "ALARMS", CONSISTING OF SECTION 30-210
"ALARMS; AND RELATED COST RECOVERY" OF THE CITY
CODE; PROVIDING FOR AN ALARM USER CERTIFICATE TO BE
ISSUED TO ALL OWNERS OF ALARM SYSTEMS; PROVIDING FOR A
MECHANISM FOR THE RECOVERY OF COSTS INCURRED BY THE
A VENTURA POLICE DEPARTMENT WHERE IT RESPONDS TO
FALSE ALARMS; PROVIDING FOR SEVERABILITY; PROVIDING
FOR INCLUSION IN THE CODE; PROVIDING FOR A PENALTY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, based on information provided by the Police Department of the City of
A ventura ("City"), the City Commission finds that the improper use and maintenance of alarm
systems within the City has resulted in a significant number of false alarms, the response to
which has placed an unnecessary burden upon the resources of the Police Department; and
WHEREAS, the City Commission has deemed it necessary to create a mechanism that
allows the City to provide an incentive to the owners of burglar alarm systems to ensure that
they are functioning properly; and
WHEREAS, this Ordinance, by the creation of a cost recovery mechanism, shall serve to
mitigate the financial harm which is caused to City law enforcement resources by having to
respond to false alarms and provide and incentive to owners and operators of alarm systems to
ensure that such systems function properly; and
WHEREAS, the City Commission finds that this proposed Ordinance serves to further
enhance the protection of the public health, safety and welfare and to protect and preserve
limited public resources.
NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE CITY COMMISSION
OF THE CITY OF A VENTURA, FLORIDA, AS FOLLOWS:

Section 1.
Recitals Adopted. That each of the above stated recitals IS hereby
adopted and confirmed.
Section 2.
City Code Amended. That Chapter 30 "Environment", of the City
Code, is hereby amended by creating Article VIII "Alarms", consisting of Section 30-210
"Alarms; and Related Cost Recovery", to read as follows:
Section 30-210. Alarms: and Related Cost Recovery
(1) Purpose of re2ulations. The purpose of this section is to place responsibility on the alarm
user to prevent, by use of appropriate mechanical, electrical or other means, false alarms.
(2) Definitions.
(a) Alarm Company: means any person engaged in selling, leasing, maintaining,
servicing, repairing, altering, replacing, providing, moving, installing or monitoring any alarm
system or causing any alarm system to be sold, leased, maintained, serviced, repaired, altered,
replaced, provided, moved or installed in, or on, any building, structure or facility. An alarm
company and/or alarm monitoring company shall be properly licensed in accordance with
Chapter 489, Florida Statutes.
(b) Alarm Site:
the building or structure or portion of a building or structure upon
which a Burglar Alarm System is installed and maintained.
(c) Alarm User: means any person or other entity that owns, possesses, controls,
occupies or manages any premises as defined below.
(d) Alarm User Certificate: a registration certificate issued by the City allowing the
operation of an Alarm System within the City.

( e) Alarm System: means any assembly of equipment, mechanical or electrical,
arranged to signal the occurrence of an illegal entry or other activity requiring urgent attention
and to which the Police Department may reasonably be expected to respond, but does not include
fire alarms or alarms installed in motor vehicles. If a fire alarm system is connected to a burglar
alarm system, this section shall not apply to false alarms that the Alarm User proves were
generated by the fire alarm portion of the system.
(f) Costs Incurred: means any and all monetary costs directly incurred by the City in
relation to the response to and investigation of false alarms.
(g) False Alarm: means a signal from an Alarm System that elicits a response by the
Police when no emergency or actual or threatened criminal activity requiring immediate response
exists. This definition includes signals activated by negligence, accident, mechanical failure and
electrical failure; signals activated intentionally in non-emergency situations; and signals for
which the actual cause of activation is unknown. It is a rebuttable presumption that a burglar
alarm is false if personnel responding from the Police Department do not discover any evidence
of unauthorized entry, criminal activity or other emergency after following normal police
procedures in investigating the incident. An alarm is not false if the Alarm User proves that:
(i) an individual activated the alarm based upon a reasonable belief that an
emergency or actual or threatened criminal activity requiring immediate response existed;
or
(ii) the alarm system was activated by lightning or an electrical surge that caused
physical damage to the system, as evidenced by the testimony of a licensed alarm system

contractor who conducted an on-site inspection and personally observed the damage to
the system; or
(iii) if the user experienced a power outage of four or more hours, causing the
alarm to activate upon restoration of power, as evidenced by written documentation
provided by Florida Power and Light Company or other applicable electric service
provider.
(3) Alarm user certificate and fee.
(a) As of June 1, 2009, it shall be unlawful for any Alarm User to operate an Alarm
System without a valid Alarm User Certificate.
(b) There shall be a penalty of $10.00 per day for each day that an Alarm System is
operated without a valid Alarm User Certificate. The penalty shall be a debt due to the City and
shall accrue interest at the rate of 12 percent per annum from the date the penalty becomes due.
(c) Applications for Alarm User Certificates shall be made on forms provided by the
Police Department showing the name of the Alarm User, the Alarm User's permanent address,
the telephone number where the Alarm User may be contacted in case of emergency, the name
and contact information of the central monitoring company employed by the Alarm User, or in
the alternative the information outlined in paragraph 6(b) of this section, if applicable. Each
application shall be accompanied by a fee of $25.00. Alarm User Certificates shall require annual
renewal for each fiscal year of the City. Effective for renewals for fiscal years from and after the
fiscal year commencing October 1, 2009, the annual fee payable to the City by the Alarm User
for the renewal of the Alarm User Certificate shall be $20.00.

(d) Properties protected by multiple Alarm Systems shall be required to obtain an Alarm
User Certificate for each individual alarm system. The Alarm User Certificate will be valid for
one year consisting of the applicable fiscal year or part thereof. Upon renewal for registration
periods beginning on or after October 1, 2010, the renewal fee will be waived if the Alarm
System has had no False Alarms requiring police dispatch during the prior registration period.
(e) In the event of a change in any of the information required as part of the initial or
annual renewal of registration, the user shall notify the Police Department of the change. An
updated registration shall be filed by Alarm User the within ten (10) days of any change.
(f) Funds collected under this section shall be applied to the operational costs resulting
from the enforcement of this ordinance.
(4) Reauired eauipment in a bure:lar alarm; Permit.
(a) An Alarm User shall not use an Alarm System unless that Alarm System is equipped
with:
(i) A backup power supply that will become effective in the event of power
failure or outage; and
(ii) A device that automatically silences the alarm within fifteen (15) minutes
after activation.
(b) A permit must be obtained from the Community Development Department for the
installation of any Alarm System and related equipment to the extent required by the Florida
Building Code.
(5) Alarm companies responsibilities.

(a) It shall be the responsibility of any licensed person selling and/or monitoring any
Alarm System to provide the user with the registration form and the Alarm Ordinance
Information form. The registration form provided to the user shall include the person's name,
address, and State of Florida alarm contractor's license number as required on the registration
form. An Alarm Company may not charge a customer a fee, other than the required registration
fee, to register any alarm system with the City of A ventura. A copy of the current/valid
contractor's license must be on file with the City of A ventura Community Development
Department.
(b) Ninety (90) days after enactment of this section the alarm installation companies
shall, on new installations, use only alarm control panels(s) which meet SIA Control Panel
Standard CP-O 1.
(c) Prior to activation of any Alarm System, the Alarm Company must provide
instructions explaining the proper operation of the Alarm System to the Alarm User.
(d) The Alarm Company shall provide written information on how to obtain service from
the Alarm Company for the Alarm System.
(e) Any person testing and/or working on an Alarm System shall promptly cancel any
activation so that police will not be dispatched.
(6) Alarm verification calls reauired.
(a) Centrally monitored alarm systems: All residential or commercial Alarm Systems that
have central monitoring must have a central monitoring verification call made to the premises
generating the alarm signal, prior to alarm monitor personnel contacting the Police Department
for dispatch. This does not apply to panic or holdup type alarms. Alarm monitoring companies

will make available to the Police Department upon request, records providing proof that the
monitoring company made the verification calls.
(b) Non-centrally monitored alarm systems: owners/operator of Alarm Systems that are
not centrally monitored must submit the names and telephone numbers of at least two individuals
who are able and have agreed to:
(i) receive notification by telephone call from the Police Department of an Alarm System
activation on the Alarm Site at any time;
(ii) respond to the Alarm Site within 15 minutes at any time; and
(iii) upon request of the Police Department, grant access to the Alarm Site and deactivate
the Alarm System if necessary.
(7) Cancelline: false alarm calls, Alarm monitoring companIes shall notify the Police
Department to cancel dispatches to alarm calls the company initiated within ten (10) minutes of
being notified that the alarm is false by the Alarm User or his authorized representative.
However, the Police Department will not cite the company for failure to meet the ten-minute
criterion if notification of a False Alarm is received before an Officer arrives at the Alarm Site.
Alarm monitoring companies will make available to the Police Department records providing
proof that the Police Department was contacted within the ten-minute criterion.
(8) Excessive false alarms orohibited. No Alarm User shall cause, allow, or permit the
Alarm System to give two (2) or more False Alarms in any twelve (12) month period.
(9) Penalties.
(a) Amount, There shall be no penalty for the first False Alarm within any continuous
twelve (12) month period. Thereafter, there shall be a fine of $25.00 for the second False Alarm,

$50.00 for the third False Alarm, $75.00 for the fourth False Alarm and $100.00 for each
additional False Alarm recorded within any continuous twelve (12) month period.
(b) Appeals.
(i) The City's code enforcement special master (the "Special Master") shall hear
appeals from Alarm Users on the issue of whether the alarm in question was a False
Alarm as determined by a police officer at the scene of said activated alarm.
(ii) Upon receipt of any False Alarm citation from the City, the Alarm User shall
have ten days from the date of the letter giving notice to request, in writing, a hearing
before the Special Master.
(iii) At the hearing, the Alarm User will have the right to present evidence and
testimony. The hearing must be scheduled and concluded within 30 days from the date
the request for the hearing is received, unless it is rescheduled by mutual agreement.
(iv) The Special Master shall make the final determination of whether a False
Alarm had occurred..
(c) Time limit for payment, The Alarm User Certificate holder shall have 30 days from
the date ofthe letter giving notice of the penalty in which to pay the penalty.
(d) Revocation of certificate on failure to pay; reinstatement.
(i) Failure to pay the penalty within the 30-day time proVIsIOn allowed in
subsection (b) of this section shall result in a revocation of the Alarm User Certificate at
the address of the Alarm System installation location. Notice of revocation shall be sent
by certified mail advising the Alarm User Certificate holder that the certificate will be
revoked unless payment is made within ten days of the date of the letter.

(ii) Reinstatement of the Alarm User Certificate will be made upon receipt of the
payment of the penalty and payment of a reinstatement fee of $25.00.
(e) Daily penalty limit. An Alarm User shall not be fined more than two hundred dollars
($200.00) for False Alarms that occur at the same Alarm Site in any twenty-four-hour period.
(f) Tax exempt entity. No penalty specified hereunder shall be imposed or assessed
against any entity that qualifies as tax exempt under the provisions of Section 501(c)(3) of the
Internal Revenue Code provided that the premises is used exclusively by said entity for such tax
exempt purposes.
10) Cost Recovery.
a) Service charge. In addition to payment of any applicable penalty or fine which Alarm
Users are required to pay as a result of excessive false alarms, Alarm Users shall also pay to City
a False Alarm service charge. This service charge is imposed pursuant to the City's authority
under its constitutional home rule powers, as codified in Section 166.021, Florida Statutes, and
as authorized by Section 166.201, Florida Statutes. The False Alarm service charge shall be in
the amount of the City's Costs Incurred and shall be imposed on the Alarm User following and
for the third and each subsequent false alarm within any continuous seven (7) day period.
b) Computation of Costs. The City's Finance Director shall calculate the Costs Incurred
by the Police Department based upon pertinent information provided in writing by the Police
Chief or his designee.
c) Appeal of Finance Director's Determination. Any person aggrieved by a decision of
the Finance Director concerning the calculation of Costs Incurred as required by this section,
may appeal the matter to the City Manager. The aggrieved person shall have ten (10) days form

receiving the written decision of the City's Finance Director to file a written appeal to the City
Manager. The City Manager may accept, reject, or modify the decision of the City's Finance
Director based on the evidence presented. Any person aggrieved by a decision of the City
Manager may timely seek judicial review of the matter in a court of competent jurisdiction to the
extent and manner authorized by applicable law.
d) Liability; Collections. Costs Incurred pursuant to this subsection (10) may be collected
by the City pursuant to the following procedure:
(i) The service charge imposed by the City for the Costs Incurred shall be due
and payable not later than (30) days after the date of the mailing or hand delivery of the
City's invoice to the Alarm User for cost recovery, and said due date shall be indicated
upon the invoice of the City.
(ii) If service charges are not fully paid by the Alarm User on or before the
past due date, a late fee of five (5) percent shall be imposed by the City and shall be
added to the outstanding invoice. Unpaid balances of Alarm Users for such service
charges and late fees shall be subject to an interest charge at the rate of one (1) percent
per month in accordance with the provisions of paragraph (iii) below. Imposition of said
interest charge shall commence for any delinquency existing thirty (30) days after the
past due date of the invoice and shall continue to accrue until all service charges, late
fees and interest are paid.
(iii) Service charges and late fees, together with any interest charges, shall be
debts due and owing to the City and shall accrue interest at the rate of 12 percent per
annum from the date the penalty became due to the City. Pursuant to the authority

recognized in Florida Statute Section 166.021, such service charges, late fee and interest
shall constitute a lien against the premises to the same extent and character as a lien for
special assessments, and with the same rights for collection, foreclosure, sale and
forfeiture as obtained for special assessment liens, and may be handled in the same
manner by the City.
(e) Implementation. The City Manager and Police Chief, with any necessary
assistance from the City Attorney, are authorized to develop and implement forms for the
efficient administration and implementation of this subsection (10).
(11) Notification of false alarms. It is the responsibility of each Alarm User to monitor the
occurrences of False Alarms at the Alarm Site. The Police Department shall notify the alarm user
of each False Alarm. Each notice shall be delivered via first class mail and shall include the
amount of the fine or service charge, payment instructions and procedures for appealing the
violation. Issuance of this notice shall not preclude the responding officer from posting or
leaving a courtesy notice on the premises.
Section 3.
Severability. That the provisions of this Ordinance are declared to be
severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be
held to be invalid or unconstitutional, such decision shall not effect the validity of the remaining
sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it
being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any
part.
Section 4.
Inclusion in the Code. That it is the intention of the City Commission,
and it is hereby ordained that the provisions of this Ordinance shall become and be made a part

of the Code of the City of A ventura; that the sections of this Ordinance may be renumbered or
relettered to accomplish such intentions; and that the word "Ordinance" shall be changes to
"Section" or other appropriate word.
Section 5.
Penalty. That any person who violates any provisions of this Ordinance
shall, upon conviction, be punished by a fine not to exceed $500.00 or imprisonment in the
County jail not to exceed sixty (60) days or both such fine and imprisonment. Each day that a
violation continues shall be deemed a separate violation. This Ordinance shall be subject to
enforcement under the Local Government Code Enforcement Act, Chapter 162, F.S. as amended,
and City Code Section 2-331, et. seq., as amended. Enforcement may also be by suit for
declaratory, injunctive or other appropriate relief in a court of competent jurisdiction or as
authorized by Section 162.22, F.S.
Section 6.
Effective Date. That this Ordinance shall be effective immediately upon
adoption on second reading.
